✎ EN EEA Polish national travelling to UK with Non EEA spouse !!!

    Hi all
    i have been following this forum for quite a while and would highly appreicate if anyone of u can help us immediately.
    im a polish national married to a non eea national for 3 years and my spouse resides in Poland currently with me. We wish to go the UK together to seek employment and my spouse has applied online to the british embassy for a family entry permit ( he has an appointment tomorrow morning). though we have read tonns of information in this forum n also the UKvisa web site we are still unclear on how to tackle the situation. my husband has an appointment tomorrow with the embassy and has prepared the following documents as specified by the application. Passport original & copy, application form and photos. he is also carrying with him an original marriage certificate.

    I have a few questions and wish if some one can advice us please.

    1. as he currently holds a 5 years miltiple entry VISIT (C-Type) visa to the UK valid till 2008. will this be a problem in terms of issuing family visa if he already holds this visit visa. and if he is issued with a family entry visa will his visit visa get cancelled?

    2.Does he need to present any more documents to obtain a Family permit? (like our bank statements in poland etc?)

    3. would i have to accompany him for the application tomorrow? and would he need to take my documents with him such as ID or passport?

    4. i have read on the UKvisa website that he could be refused a family entry visa if the embassy is not sure about my travel to the UK? and would i have to prove in some way that i would like to exercise treaty rights in the UK?

    5.and finally if he can travel to the UK on his visit visa with me and then apply for a residence ? or would he have to have a family entry visa?

    kindly help anyone ( TripleH or polskasweetie) as we are in desperate need of advice and help.

    hi TripleH

    my husband went to the embassy today and was told that he needs to bring in more evidence to prove our marriage and few other things. i think this is good information for other people who wish to use the same process of applying for a family entry permit.
    My husband presented a few documents such as marriage certificate and passport and bank statements but the lady in the embassy told him that a marriage certificate alone does not prove marriage or that we are living together and asked him to bring in more documents.

    he was asked to bring in the following documents...

    1. both original passports
    2. marriage photos, family photos, vacation photos
    3. any proof that his wife has a job offer or if she is going to the UK to look for a job then her current qualifications, letters or reference from her present or previous employers that she is working and is qualified ( that when she goes to the UK she can find a secure job and not depend on public funds)
    4. her diplomas and degree certificates
    5. proof of us living together(telephone bills, utility bills, Emails) , ( i dont know how an email can be make any difference though)
    6. wifes property documents if she has any.
    7. proof or letter from some one in the UK where we will be living for some period of time.
    8. bank documents with statements of 6 months( this should be a joint account is what the lady suggested)
    9. proof of funds to be taken to the UK via bak statements or travellers cheques
    10. if possible for both husband and wife to come to the embassy if they need to interview us.

    that is a hell a lot of documents needed ...................


    basically any proof that we are married for 3 years and docuemnts that we are living together for 3 years and proof that she can find work in the UK before leaving Poland.

    the reason for my husband to apply for a family entry permit was to come to the UK along with me and find a job before i did and we would then apply for EEC1 (residence permit filed by an EEA National) on the "self sufficient person. and then i could look for a job thus helping us to bypass the 12 months waiting period.

    If i really wanted my husband to live with me in the UK then i could have done so with his 5 years visit visa and he could stay for 6months at a time and then fly back and forth till i get my residence and he could apply for a family permit when i either get a WRS or residence after 1 year.

    Unfotunately the process seems so complicated and weighted that we have to abide by the laws created under these circumstances. i guess there are a lot of non EEA nationals leaving poland with similar instances as this is one of the hints he got from the lady in the embassy.

    well all said and done he did not process the application today ( since the lady said it would be rejected just on the basis of a marriage certificate) , ( which according to her was not proof of a marriage). so we are ever so determined now to get this visa and will go next week to apply with all documentation.

    im not sure if u could advice me on how to make the next few steps or take any precautions regarding our next visits but would highly appreciate if u could give us some sound advice.

    thanks once again for the great information you have posted in general and all the help you have given those 1000's of couples to make it successfully to the UK.

    before i finish this long and boring topic( since u must have read over a million of them by now- i know how it might feel) i would like to advice all the people out there that the web sites posted by the embassies across different countries might not contain 100% of all the information. the reason i am saying this is my husband went to the embassy with all relevent documentation as proposed by the embassy web site in English. but the lady said that if he or his wife has read the web page in Polish version it has lots more information as to how to prepare and what exact documents to bring along with marriage photos etc.. so all u guys kindly follow the forums in detail and also cross check web site if u are living in foreign countries.

    As from 30/04/06 new rules may apply,there was a talk about it.I do not know full extent of new regulations.
    I was reading about it elswhere and one thing is for sure it will not be as easy as before.
