Shoptime Aussie engaged to Brit!... advice needed please!

    Hi there,
    This is the second time I have looked on this site and I thought I would post my current story and see if anyone can help..am feeling quite stressed.

    March 2004 - March 2006 I had a working holiday visa (granted from australia). I left london in March this year once my working holiday visa ended, and have come back into the country for a month (june-july, am still here) to see my boyfriend who is now my fiance. Basically we are planning for me to come back to london on a student visa to study and were thinking of planning a wedding in australia in january (possibly), but how do we go about getting me a fiancee visa?

    We spoke with people at the home office who told us 2 different things. 1) that i would have to apply for fiancee visa in aus and wait months for it and THEN i could come back to the UK, and 2) that i could get the student visa and whilst i am on the student visa, i could apply for a 'letter of approval'??????

    what exactly is this letter of approval? I read i can apply for it whilst i am in the UK, but will i still have to go back to australia ?

    We do not want to b separated for months and would like to plan our wedding for sooner rather than later...

    Can anyone help us? Basically, do i go home this month (i am leaving in a week) and apply directly for the fiancee visa and wait for however long it takes, or do i apply for the student visa, come back and then apply for the letter of approval????

    ALSO: i was detained at immigration for 2 hours on my way into the country now because they wanted to know why i was coming back so quickly after my working visa had ended. i said it was bc my boyfriend is english and we had to go through a whole process.. just wondering if this would hinder anything?! i ended up getting a 6 month visitor visa which i am here on now...

    I cant think of anything else, but if i do, i will post!

    When do I apply for the COA? or does my english fiance apply for it?

    If I apply for the student visa and then soon down the track I apply for the 'letter of approval', will i have to go to australia at all, or it means it can be done from within the UK whilst I am here???

    So many unanswered questions!

    quick note:
    we have spoken with a lawyer, and apparently there is absolutely NO point in applying for a student visa seeing one of the main criteria of the student visa is to make sure they know you are returning to your own country of abode after you finish your study. If you can not prove that, then they will likely not give you the visa. If you are interviewed and they realize you have a boyfriend/fiance in the UK, then they will obviously realize you do not have the intention to leave the UK after your study....
    make sense?!
    basically no point risking the study visa/COA option...

    so I going for fiance visa and hopefully it will all go well.!

    Fiance Visa Update!!!!!

    I GOT MY UK FIANCE VISA!!!!!

    It took less than 48 hours!!! it took us longer to get our documents (over 1 kilo's worth) together... i sent it off to canberra on monday afternoon, it was signed for on tues morning at 730am (i found this out), and this morning (thursday morning) at 830am, my documents came back including my passport with my fiance visa!!!!

    i think getting detained at immigration back in june for 2 hours asking me about my relationship....my have helped...considerably?!

    woohoooooooooooooo

    B positive people! if ur legitimate, its all good!
