✎ EN Family Permit to the UK, Please Help.

    Hello everyone,
    Thank you for reading this post. Here is my story,
    I am from Palestine, currently living in the USA. I am married with Polish citizen for two years now. We are both illigal in the US spent the last 6 years trying to survive. 6 months ago, someone told about me to the immigration and i am in deportation now. I must leave the US before August 11 2006. Well i am leaving in July 25th.

    We found out that my wife can get me family permit to the UK, which sounds great. The only issue we cant figger out is which better. She goes 1st to the UK, find a job and appartment and then i apply from Palestine, or she stay in the US and i apply as we both will move together.

    Our concern is the waiting time period for how long we will be apart based on the application proceesing time, and which will be a stronger application.

    Also does anyone know, how long the application process takes? and did anyone hear of refusal of application?

    What really scaring us, we have to ship by a container all our stuff in the US to the UK, she goes their find a job and start a life then they refuse my application. It is very scary especialy that i have really no country to stay.

    We do have saving of about 20,000 us dollars that may help our application.

    Please advise us with any information you have. I am runing out of time.

    You can try to apply from USA,but it will be tricky.You can be refused on the spot as you do not have a residence rights.You supposed to apply from your country of residence,which in this case are Palestinian teritories.
    Going back there do not seem like good idea to me.
    As for the alternative route ,I just dont have an idea.

    That would certainly help.

    Family members can apply for the EEA Family Permit at any British mission overseas that offers a full service visa-issuing office. If they are applying from within the EEA, they will need to show that they are living legally in an EEA member state.



    There is no mention that you have to be in your country of residence.
    Still as a ilegall my guess is that you will have a problem.

    I have no choice just to leave to Palestine, I called the embasy here in Chicago, and they said i have to show my visa and proof of my status in The US. I think applying from here as you said, will give them a reason to decline it. So i have no choice just to go to Palestine and apply from there.

    I need to know, if i will apply from my country Palestine, and tell them that we will move to the UK together, and proof to them that we have a friend who will five us a place to stay and show them that we have saving will make them approve it?

    My research showed that there are only two reasons to decline the aplication, if my wife has no right to reside in the UK, and if our marrage is a convenience marriage. Is this is real, or they still may refuse it for other reasons. Well, she has the right to reside in the UK, and we can show that we been together for four years and married for two.

    And :danger to public order or security!

    You should be fine in my opinion.
