Hi, I'm a Canadian citizen and I've been living in UK for the past 18 months on a Working Holiday Visa. My partner is British and we have a 9 months old baby who's also British. My partner is disabled and therefore, cannot work. He receives benefits (Disability Living Allowance, Severe Disability, Child Benefit, Tax Credit, partial Housing Benefit). I do work, but do not earn enough to support us all. I was wondering if I could apply for a Marriage Visa because I read that both people can't have access to public funds. My other option would be to apply for a Working Visa, but I do not know if it'd be granted. I have been working as a cleaner in a nursing home for the past 5 months.

I'd really be interested in knowing if a marriage visa would be possible, considering the fact that my partner is disabled and unable to provide for himself. What is my better option and what are my chances? My visa runs out in 6 months and I'm getting a bit nervous.

    Thanks, Unnie28

try to contact that imigration lawyers , they not charge when u ask them just question ..
i think it would be discrimination against disabbled because then they can never have vistors form other coutries or get married or other visa stuff just because they are disabled and are getting benefits ... its seem nonsece to me

(i think that marriage visa are for pople who just want to come to uk to get married not stay )

COA and getting married should be an answer as recommended elsewhere ;)

    Good Luck

I agree, if you want to get married then that is the best answer. Apply (now) for COA. Then switching to a spouse visa is as simple as proving you did get married.

For the financial test, do up a sheet detailing all incomings (all allowances your partner is entitled to, and your salary) and all outgoings (rent, bills etc). As long as you can show you can support yourselves without YOU seeking any public benefits, then you will pass. Your partner is allowed to claim whatever he likes and is entitled to, including child benefits for your baby - these benefits are his right as a UK citizen.

Good luck with it all, and let us know how it went on!
