✎ EN US Girl Marrying UK Guy...Fiance to Marriage Visa Question!

    Hi out there. I'm hoping someone can help me. I am an American citizen marrying a British citizen 31st of May 2006. I am so confused about my visa status, I was hoping someone can give me some advice.

    I have the fiance/marriage visa that allows me 6 months to marry in Great Britain. I applied for a Certificate of Approval once I was here (because when I read the Home Office website I thought I needed one) and was told that my application was voided as: 'your entry clearance under the category of Marriage gives you the right to marry in the United Kingdom without prior permission of the Home Office, at any time before 1st September 2006, when your marriage visa expires.'

    My question is: when we are married, will that be proof enough that I can legally work in the United Kingdom? Is there any other visa or documents I need to apply for, because mine says it's a marriage visa, and I've been reading on different sites that if you have a fiance visa you must apply for a marriage visa.

    I've tried the gov websites and find them so confusing and I desperately need some help in knowing if this is the last of the paperwork I need in order to work legally here in the UK. (At least for awhile...I've read about applying for a extension of stay after 2 years of marriage are over).

    Can anyone help me PLEASE??? I'm going crazy! I am hoping to have contact with someone that has had to go through this before, because I am so unsure! I have worked so hard getting this far, I need to know if now I have to do something in order to get a job here. I have interviews lined up after the marriage, but I don't know what to show prospective employers that I can in fact work in the UK.

    I don't know if showing a legal marriage deed in the UK is enough to be granted employment...do I then apply for a National Insurance Number? I am married in 10 days, and I'm so stressed now, but I'm even more so if I have to wait and apply for another visa/document in order to work here! :oops:

    Once you get married, you'll have to apply for the Spouse visa. Once you're granted that, you'll be allowed to work.

    The visa you've apparently received basically states that you must get married within 6months time, then you'll have to apply for the Settlement: Spouse visa. Under the Fiance visa, you are not allowed to work!!! This is a seperate visa that you must apply for in your country of nationality. After you've been granted this visa, you'll live in the uk for two years on probation. You will be able to work at this time!!!! Once that period is up, you can apply for ILR (Indefinite Leave to Remain) with form set(M)

    Do I have to leave the UK???

    Thanks for the help regarding my visa! I understand I need to apply for the Spouse visa after I'm married on the 31st of May. The next question is, do I have to leave the United Kingdom to apply for this visa?

    I'm already here in England....PLEASE don't tell me I have to fly back to America to get this updated visa?!? :eek:

    It appears I was mistaken, and in fact, I had two controdicting websites, but this third one proved right.

    Just apply for a spouse visa.You already have a marriage visa and you are allowed to extend it!You dont have to go anywhere!!!

    OH GREAT!!!

    I am so happy, and I was ready to go to New York to apply, but I'm BOUNCING OFF THE CEILING WITH HAPPINESS knowing now I don't have to go back to the States.

    I have visited all the websites you both have given me, but cannot find the correct address to send my application to within the UK.

    Can someone give me assistance?

    If you have a setllement visa for the UK....

    Can you work in other European countries? My wife has just got her settlement visa, and we don't know when or whether she could work in any other european countries. I, as a Brit, can work anywhere in the EU that I want to - can she do the same?

    The answer is yes she can, but only if you as an EU citizen is settled/working in that EU country. This will give her the same rights as you in that country.

    If she wants to do it on her own, she has to apply for a work permit from the country concerned.
