    Hello

    I am an Irish citizen in UK (now been working here for 12 months)
    My Wife is Argentinian and is here on Family permit (expires July 2006)
    Have read thru the forum but still have a few questions I hope you can help with:

    I believe I need to apply for EEA1 and she needs to apply for EEA2 - correct ?
    If submitted at the same time will this be processed simulataneously?

    Can this be done at PEO Same day Service for £500?

    If postal application - Do I need to send my Irish passport or a certified copy of my passport to support her EEA2? - if needs to be certified where can I get this done?
    Form does not specifically ask for Marriage Cert (which is from USA) but presume I need to send certified copy?

    Can I send the original (or certified copy) contract of employment as proof that I am employed?

    Hi, as an irish citizen you have two options:

    1. Apply with forms EEC1 and EEC2. It´s for free, your non eu partner will get a 5 year permit and only after 5 years she/he will be able to apply for permanent residence (ILR) and then 1 year more to get the citizenship.

    2. As an irish you can apply at PEO for 500 pounds - irish citizens are considered as "present and settled" in the UK laws. Even one irish has just arrived in the UK he is still considered present and settled. Irish citizens have a special treatment in the UK.
    With the for SET... not quite sure exactly - look home office page to see if it´s SET (M) or (O)... it would be 500 pounds BUT in 2 years your partner can apply for permanent residence!

    So you can choose the route you go through.

    Glauco forms are different as from october last year.
    EEA1 AND EEA2 now.
    Great info about Irish thought.

    Sorry, and thank you for your correction!!!!! Big mistake i did, hehe...

    By the way, talking about EEA applications, I just noticed that the Home Office updated the page regarding EEA applications:

    The page is much better now, and it explains more abotu the categories, etc.
    In the end of the document they even show "Documentation issued to successful applicants" telling that they are replacing the old stamps, etc. Very good.

    I noticed as well that they write telling the processing time for applications.
    They call different names, first Registration Certificate, then Residence Card, etc... I checked each of the forms, EEA1, 2, 3 and 4, and I noticed that in the Form EEA1, in the first page it´s written Registration Card, then I checked form EEA2 and it´s written Residence Card, and so on.
    So the details in the page shows exactly each type of application and the time it takes to deal with them.

    Note that:
    Registration Certificate applications April 2006 ***EEA1***
    Residence Card applications February 2006 ***EEA2***
    Permanent Residence for EEA nationals January 2006 ***EEA3***
    Permanent Residence for non-EEA nationals January 2006 ***EEA4***

    And as well, if you check form EEA1, now it´s possible to apply in person! However only if the person books an appointment.

    They allow only 30 applications per day, and only for EEA1 form, so dependents cannot use this same-day service.
    It seems that they are improving a bit the service for EEA applications anyway!

    Just a quick to update / clarify and hopefully save others some time / grief on this never ending twisted and complicated road

    EEA forms cover European Law
    The forms below cover UK Law

    Form SET (M) is only applicable if spouse / partner has been in UK for probationary 2 year period

    Form FLR (M) is applicable for spouse / partner who has been in UK less than 2 years but wants to apply for 2 year extension.

    Both of these can be done at PEO office same day (£500) service or £335 by post BUT.......

    If your spouse or partner initially entered UK on EEA Family permit (under European Law) then you are not allowed to switch to UK Law. Initially tried to make an appointment for SET (M) last week but was told it should be FLR (M). After calling to make an appointment today for FLR (M) was given the news that we can't switch from EU to UK law (and they didn't tell me this last week because...???). Having been thru about 5 years of immigration fiasco with US residency & citizenship (took 2 years to re-issue my green card and 'lost' my citizenship application for 3 years) - this is just par for the course!

    Yes - when I phoned up to double check about the initial Family Permit application in January (which we lodged from outside the UK) the lady at the IND warned me in advance that I couldn't decide to change from EU to UK law halfway through (I have dual French/British nationality). She was quite specific about this, so I'm sure it's thwarted a lot of people in the past! I decided to stick to the EU route anyway, much cheaper. Now I am about to lodge the EEA1 and EEA" applications so fingers crossed.

    posted our EEA1 and EEA2 applications on June 30th - got the passports and residency docs today - 3 weeks is pretty impressive!!!!!
