    Hi,

    I would appreciate any advice on my predicament:

    I am an Australian on a 2 year Working Holiday Visa, which expires in August 2006. My fiance ( we have been together for 7 years, living together for 6) is an EU national. We were orginally going to get married in the UK over the summer and than apply for an EEA2 residence permit, however this is looking unlikely for a couple of reasons:

    - My fiance is being transferred to Bangkok for work for one year in August, with the intention of coming back to the UK in August 2007 (I will go with him)
    - Therefore this will not allow enough time to wait for permission from the Home Office to get married (4 - 14 weeks), and then apply for an EEA2 permit (4 - 14 weeks again).

    I wanted some advise on what my best options are.

    Option 1 - apply for a EEA2 permit (as defacto) before I go to Bangkok
    - we need to prove that we have lived together for the past 2 years - say I apply on the 1st June 2006, does that mean I will need documentation dated around the 1st June 2004 as proof of living together, or do I need documentation 'within' that period?
    - when we arrive back in the UK in August 2007 (after a year in Bangkok) and I wish to apply for Indefinate Leave to Remain, will I still be eligible even though I didnt live in the UK for 2 consecutive years?

    Option 2 - apply for EEA2 permit (as spouse) in Bangkok
    - How long does it generally take for an EEA2 application to be processed from Bangkok?
    - I wont have a job lined up when I return to the UK - will this be a problem?
    - My fiance will have proof of employment (even though he is working in Bangkok, it is with his UK employer and he will be sent back to the UK after 1 year), however he wont have proof of residence. Will this be a problem - even if we make it clear that the residency in Thailand is only temporary and that the company intends to send him back on the date mentioned?

    Based on my situation, do you think there are any other options available to me?

    Go for this option.What you will be asking is Family Permit,not EEA2.Once inside the UK you will have that option.It would not take long to sort out that in BKK,week or two.

    Thanks Triple H for getting back to me.

    If I apply fr a Family Permit, will there be a problem that my husband will be in Bangkok at the time, and not residing in the UK?

    Also, will I be allowed to work in the UK on a Family Permit?

    Not a problem.He should just explain in supporting letter that he was employed by British company in Thailand and that you are moving back to the UK.Apply with as many as possible supporting documents.I dont think you will have any problems.
    You can work on Family permit.

    Triple H, my working holiday visa expires on the 14th August, but Id like to stay in London for 2 weeks and leave end of August. Obviously I cannot overstay my visa, as this will prevent me from returning on a Family Permit.

    Is there are 'safe' way of doing this? For instance, leaving and then coming back on a tourist visa? Is this an option? I dont want to jeopardise my changes later on.

    Oh well,you would have to leave and come back,but I would advise you to buy onward ticket as a proof that you would be flying away at the end of August,just in case that Immigration officer start asking some questions.
