"Just before the expiry of the initial two years leave to remain as a spouse/partner, an application can be made for indefinite leave to remain in the UK. The Home Office may check that the couple are still living as husband and wife. Once indefinite leave to remain is granted, the foreign spouse/partner will be allowed to access social security benefits and, of course, will be allowed to continue to be employed.

Just send the proof that you`ve been living together e.g accommodation details,payslips,bills ,bank statments.

I'm a South African citizen that also has a spouse's visa but I have overstayed the two years because on the application form it actually said that
you should apply once the 2 years have expired. Spoke to UK immigration today and they said only way to solve it is by going back to SA and get another visa(if another is granted of course)!!! Has anybody got some info or help how I can resolve this other than going back to SA??

Case in point. Here's an extract from the rules of immigration stating that you have to apply after you stayed here for two years! Somebody please help!!!

If you have been married for less than four years, you will be given a probationary period of residence for two years. You will be entitled to apply for indefinite leave to remain after you have lived in the UK for two years, provided you can prove that you have been genuinely living together as husband and wife.
