    Hi,

I wanted to know, what do I have to do after my fiancé and I are married.

The Home Office told me that once he and I are married, I do not need a work permit. Do I need to submit my passport and his passport along with our marriage certificate to the Home Office once we are married? Do I need any visa? As well, I have a 7 year old and of course I can prove that it would be detrimental to her to not be allowed entry at the same time as me. I am her sole custodial parent and we have no other family for her to stay with while her forms would be processed.

    Thank you.

    Hi

I would appreciate if you could explain your situation in full.
    What nationality is your fiance?
    Is he residence permit holder?
    Where do you live?
What kind of visa do you have ,if you live in the UK?
    etc..

Re: Canadian marrying an EU national

Hi, sorry I wasn't more clear.

Ok, I am Canadian, and my fiancé is Austrian. We are getting married on Saturday, and he works in the UK - and according to the information I have read at British Immigration sites, any EU national and their spouse is entitled to live in the UK.

We got our permission to marry at through the Church of England practice of publishing the banns. Which was all approved by the diocese immigration lawyer because I do not wish to take on British citizenship.

In other words, I satisfied their requirement of wanting to marry for love - not immigration purposes.

As for residency permit, I don't understand that. It is my understanding that as he has employment here, and according to the information I found, he is entitled to live here by virtue of being an EU national.

I am currently here on a 6 month visa, which will expire in July. I am not entitled to work, however, once he and I are married, then the Work Permit division of the Home Office told me that I will be able to work, and will not need a work permit. They did not say anything to me about residency permits or visas. Can you explain that to me?

Once you are married, you would have to apply for a EEA1 and EEA2 simultaneously. And thats it.

    http://www.easyexpat.com/forums/ftopic_6792.htm

You have to have residence permit so you could work!

    ??????

Thats nothing to do with British citizenship. If you live lawfuly in the UK , you can become British after 5 years.

What about my 7 year old daughter? Do we need to apply for the EEA2 for her too?

Canadian married to Austrian - thanks

Thank you for all your information. I will contact the Home Office about applying for those EEA1 and EEA2.

Thanks again. Any idea how long it takes to process those forms?

    Canadian marrying Austrian

Gee Whillikers! From reading the posts on that form about the EEA1 etc, I guess it would not be wise to book tickets back to Canada during Easter Vacation! I was hoping to take my daughter home for a visit so I guess we will have to wait until half term in October to go.

Thanks for your help, I really appreciate all the information. This is truly the best resource for information that I have found!
