Hey everyone! I've posted a few questions regarding a Danish/American union with a Dane living in Ireland. I understand the process from Ireland and am beginning to grasp the US concepts. One question, though:
Do you have to file an affadavit of support for a spousal greencard? The reason I ask is according the the K-1 requirements, you must show 3 years' earnings of about $15,000. The issue here is that I've been finishing university courses the past 3 years and will not finish until November 2006, and I do not meet that limit. I miss by 1000. I am not on any kind of state assistance inspite of the low wage and fully support myself, work, and attend school fulltime. I also expect he, upon arriving to the US, will seek and find work as soon as he's cleared to do so. Upon finishing school, my salary will more than satisfy earning requirements.
So, is there a set limit for an affadavit of support for a spousal greencard application? If so, are there any exceptions to it?Does this greatly complicate the process? Do you think we should hire an attorney to make sure t's are crossed and i's dotted and advise what we can and can not do?
    I appreciate the help!

Ok.. well, actually, over the weekend, I did some snooping and would like to run by the answers I have found.
Firstly, since I plan to marry in Ireland, I will have to file for a k-3 visa for my husband. Is this correct? Also, is it possible to do a direct consular filing of the I-130 in Dublin even though I will not be a resident at that time or will I have to file everything stateside? Or, since I will be applying for an EEA permit, would that in a sense satisfy residency and allow us to file DCF in Dublin? We will apply for EEA right afterwards as we want to make sure that I can get into Denmark should we decide to go there, but I will have to return to the states to finish school and he will have to wait for his clearances to enter into the states. I understand that I can't really justify Irish residency anyway without the EEA permit, so could this be a way around filing stateside? I understand from what I read that DCF is a faster process and the sooner we can be together the better :)
I understand that the financial situation shouldn't be a problem as I found I can have a co-sponsor. Does this mean I should first apply my financial information and be instructed to get a co-sponsor, or should I just have my co-sponsor fill out the paperwork initially? I want to do this right the first time so as to not have any unnecessary delays. Can someone who knows better than I take a look over this info and let me know if you have any clarifications or suggestions?
