✎ EN Non EU wishing to live with EU partner in Austria

    Ok I'm really worried. I'm a non-eu (NewZeland) citizen.
    I've been with my hungarian(EU) boyfriend for two years but we have not lived together as we were both finishing school and in different countries most of the time.
    We want to get married and live together while studying in Austria, the problem is he needs to start in Oct 06 and I cant start until Oct 07 but I don't want to be back in NZ for a whole year without him. I can only recieve a 6month visitor visa to Austria as an NZ citizen and that would make it difficult as I wouldnt be studying and wouldnt be able to work on a visitor visa, my student visa would allow me to work part time as of Oct 07.
    My question now being as the wife of a hungarian national could I live with him in Austria, could I also work? And is it going to be a problem that we havent lived together? we really want to but it seems like the world is against us!
    What options do we have? I just wanna be with him finally.

    thankyou that's helpful. How long do we have to be married before I am given the same rights as him under 'spouse'
    Is there any given time period that we must live together?

    I dont have a knowledge on Austrian immigration rules and regulations regarding accession countries.

    thanks for your help,
    ive just read through a whole heap of websites and it appears that in eu law they will be widening the definition of spouse to unmarried partnerships as well. It says that each state will be required to define a process for allowing free movement that is does not discriminate against same sex couples. It said each country would have to have this determined by april 2006.
    Does anyone know whether any particular requirments exist for Austria?
    eg. Do i need to marry my boyfriend in order to be considered his spouse? If I had a civil union from NZ, would I then be considered his spouse?
