    Hi

    I am a dual NZ / UK citizen living with my NZ fiancee in UK. He is on a working visa which expires in Dec 06. We are returning to NZ to get married in March this year and then come back to the UK. He will come back in on his workpermit as we will only be back in NZ for 2 weeks.

    We were planning to use our NZ marriage licence when we got back to apply for a spouse visa for him to remain in the UK after December 2006, and I was advised this was ok, however now I am concerned about the information I was provided.

    Can anyone help me understand whether this is ok or are we in trouble??

    Hi,

    Good news for you.No problems whatsoever.Rules are here:

    If you have a visa valid for six months or less in the UK you cannot change status to a spouse visa.


    Your spouse to be will qualify,he `ll have more then 6 months..As soon as you come back to the UK apply to IND.
