✎ EN How much £££ to approve fiance visa ??

    hi... i m sure u guys wod help out.. thanx in advance..!!

    I am indian and my Gf is from poland. We know each other from more than one year now. My student visa has been refused 'coz the college i was enrolled was not registered with the department of education and skills so i m due to go back to india by the end of january.. I still plan to come back to join my GF and i am planning to come back on a fiance visa .. Could you please let me know :-

    1 ) How much finances she need to show to have my fiance visa approved ??

    2) how long is the process of getting a fiance visa from india ??

    3) If a refusal of my student visa would be a problem for the fiance visa ?


    i would have preferred to come back on a spouse visa but to get married in india.. its got to be atleast 30 days stay and then 30 days notice for marriage ... u think it could be quicker ???

    plzz guide me as you guys are SUPERRRR - GENIOUS ..!!

    So, you have decided not to appeal against the decision.
    In any case ,can you tell me what is situation concerning your wife to be,is she resident, has she got a job?
    As much info as possible.

    thanx for the quick response.

    So, about my to-be-wife...She is working from last 16 months in one place and she did apply for worker registration scheme and got herself registered when she started working. Although she hasnt applied for residence permit but i assume that if a person works at one place continously for one year he/she automatically gets residence rights and they can work freely.She earns around £1000- £1200 every month. She has a national insurance number. she has like £3000 in her bank account. we pay £500 every month for flat .. when she will sponser me for fiance visa... she will be showing that she pays £500 for flat every month plus £50 of bills... she gets paid every weekly into bank account. So, watever she earns and has in bank account.... is that enough finances to approve a fiance visa or less...??? if no, how much is needed ?? do i need to ask my parents or any relatives from uk to sponser me ??

    Also, about my case .. my visa got refused january 2005 and i appealed agianst home office but now they have set up appeal hearing date 27th january . Although i did change my college when my visa was refused in januar 2005 on the basis that my college was not registered with deparment of skills /education. I have finished my one year degree with good attendence record and good grades in a college that is registered with department of education and skills. I even have enrollement letter from this college for next yr course starting january 2006. But the solicitor whom i paid to appeal against home office is asking for £ 950 to carry on to appeal hearing and when i asked how much chance i have of winning... he goes "50-50"... so i m scared pursuing with him..... Do u think i can win this appeal saying that i should be granted visa 'coz i am studying in a registered college now ??? or they will still stick to previous circumstances.?? CAN I RE APPLY FOR FRESH APPLICATION OF STUDENT VISA BEFORE THIS HEARING WHICH IS IN LIKE 3 WEEKS TIME ??


    Mr. SUPER-GENIOUS.... plzz guide me through out of this messy complications...!!

    I had some thoughts about your case last night,but with all the extra info you gave it to me I must tell you , it does not look very good.It is messy, but one thing for sure , you have to make decision yourself.
    Concerning your fiance status,she MUST apply for her residence immediately.

    I am not sure if this is the course of action I would take.Its costly takes long time and you would have to wait for your fiance to get her residence,as well as to wait in India.She would meet criteria thought.

    If you were to contest the decision by IND, and try to win the case,and win and fiance in the meantime gets her residence you could apply for this
    Unless you are engaged to an EU Citizen (not British citizen in this situation!) with a five year residence permit you must apply for entry from outside the UK.

    You could apply for the certificate of approval.

    Both these options have IFS an BUTS with no end insight.

    Regarding new fresh application , sorry I do not have that information at the moment.

    Marry elsewhere,that would be ideal and apply from India for family permit! ;)

    so u said " Marry elsewhere and apply for family permit"... I talked to her.. she said if we marry in poland we just have to give one month notice together and then we can marry. I m thinking of this. hope its a good idea and i m sure there is not that much queue in poland as in UK... But if i marry in poland, how would we be able to come to UK together ?? Does she neeeds to have residence permit by then in UK to have me here ?? How it works after marrying poland ?? how can i join her in UK ??


    Also, if i try to fight in appeal hearing and suppose if i loose, would i have any trouble going back india ?? If i win that will sort out everything 'coz i will have one year to sort out things and that will be great...

    so plzz tell me :-

    1) After marrying in poland , how can i join her in UK ?? wat documentation will be needed ?? residence permit for her ??


    2) if i loose appeal, would i have trouble going back... or is it better to withdraw my appeal ???

    If you were to marry in Poland you would have to apply from India,rules are here:

    They can apply for the EEA Family Permit at any British mission overseas that offers a full service visa-issuing office. If they are applying from within the EEA, they will need to show that they are living legally in an EEA member state.

    Your appeal is different all together,even if you were to loose appeal and marry at the later date,your circumstances would have had changed at the time you make new family permit application.Whatever you do ,do not break immigration law.

    Tell me about your appeal,is it in written format,some sort of hearing,or in court?I am only familiar with Court of Appeals where people fight theyre deportation.I have attended one of those(Court of Appeals)

    i have an appeal hearing about my appeal in front of adjudicator who will decide my fate... if i will win i will carry on studying and sort out Certificate of approval here and sort out things about marriage BUT if i loose. its a lot of waiting and hassle lying in front of me.... So. dont know whats gonna happen...

    I think i will carry on to pay a solicitor to attend my appeal hearing and focus in the pint that last whole yearr i did my studies in a college that was registered with deprtment of educations and skills and also, point that that a student was not aware that college has to be aware of the fact that college or UNI has to be registered with department of skills to be recognised.... Lets see wat happens... I am gonna carry on with this appeal hearing and try to win this battle...
