✎ EN Wanna go to usa so bad please help

    Hi im nikki
    I live in the uk, i married a guy in the usa 3years ago ive known him 5 years, he is in prison tho, i never really wanted to move to the usa but since getting to know his family id like to i have a home with my inlaws, job offers coming out my ears every time i go there, but poeple say its impossible for me to go there and stay for good, is this true?
    please can anyone help

    If you are married in the USA, didn't your husband apply you a spouse visa shortly after that? I'm assuming he's an American citizen. If he is, then whether he is in prison or not, you should start the paperwork for your spouse visa, if you don't have one. Do give us more information, when was he jailed and for what, where have you both been living the last 3 years, etc.

    we were told i couldnt fill in one of those visas, cos he was in prison and could not support me though his family are willing to do so, i dont really want to go into his sentance its a long story and were still fighting it, but he is in for a long time and has been there for 9 years already, yes he is american soon as people know the reason why i want to go to the states they dont want to help, all i get told is i need a million dollors, but others seem to get there without it,
    im still in uk and travel back and forth several times a year and stay long as i can, i cant remember what els u asked so hope this is enough,
    i dont think i will ever get there, i dont know what other info i could give you, take care nikki

    Your husband's parents or immediate family members can sponsor you for your spouse visa, not necessarily your husband has to do it, especially in this case. As long as you have documentation that you are legally married, then yes you have a right to be there in the US, whether your husband is in prison or not. You would need financial documents or employment documents from where you are living now as supporting evidence that you do not NEED to be in the US, but rather want to. And hopefully your in laws help you out with the paperwork. You and them can start consulting an immigration lawyer. What state is your husband in anyway, or your in laws? I'm thinking of law offices that may be able to help you, but I need a location.

    he is in Tennessee, so are his parents,where did you get this info from so next time someone says i cant, i can say i can and tell them where the info is, i have taken everything as gospel, as i didnt know any different, and i tend to do as im told, thank you so much for your help

    We are not judging you, just making sure we get enough facts to be able to give you better advice. So now it seems you got married while he is in prison. As I said in earlier posts, if that marriage is at least a civil marriage and recognised in the state of Tennessee, and if you have a government document like a Tennessee issued marriage certificate, then US law states you can get a spouse visa filed immediately after the marriage, as you would need to supply an original copy of the marriage license to accompany the visa application. Your in laws should be able to help you out with the paperwork. I highly suggest if you can go to the US the next time, meet with a family/immigration lawyer with your in laws to discuss your paperwork and how to go about it. As long as your marriage is a legally recognised one, then you are entitled to the spouse visa. It won't be an easy process, but it's not impossible either.

    Sorry but I don't know anyone in Tennessee so I won't be able to recommend a lawyer for you, but your in laws should be able to find one prior to you going there and already explain the situation in advance so when you go, you can bring whatever necessary paperwork the lawyer needs from your end to start the paperwork running.

    Do you honestly belive that in the case like this looking at the circumstances she would have a chance of succeeding.?The lawyesrs would cost her ££££££££££$$$$$$$$$,and she would need "Michael Jacksons" ones.Sorry but I very much doubt so.

    please dont argue, yes it is all legal i got certificate, the licence part had to be sent back after it was all signed when we got married, i will go see one when im next there but for the time being i will just go back n forth like i have been doing thanks for ur help anyway take care nikki

    Yes it is legal, since she has the paperwork proving the marriage. That is a very important document that will help her, her husband's parents, and the lawyer, in obtaining her spouse visa. It is not her fault the husband is in prison and cannot do that on her behalf, but yes, she is entitled to the visa, as long as she can get the paperwork done.

    I know you feel very frustrated and anxious at the same time to be there and see your husband and in-laws, and not have to go back and forth to do so. With patience, you will get what you want. Just make sure you consult a lawyer to help you answer the questions in the immigration papers, as your answers have to be consistent. Good luck.
