    Hi there,

    I was hoping that someone could please help me. My girfriend and i have just got engaged. She is a US citizen and i am from the UK. She is currently in the uk living with me however her current student visa is to expire in february.

    Could someone please let me know of how we are best to go ahead and wed to ensure that we can stay together and that she can remain in the country - as she is in full time employment and by having to go back to the states for any length of time will probably result in her losing her job - not to mention me suffering from depression!!

    Would it be best for us to travel out to the states and get married there and then apply for a spouse visa or is there any better way around this?

    If anyone could help me i would be most greatful.

    hi there

    she came to the uk through bunac on a 6 month student visa after having graduated this summer. the terms of her visa stated that she was free to work full time in the uk, which she is now doing.

    hope that this makes sense.

    any further advice would be much appreciated.

    You have 3 options.
    1. She goes back to US apply for fiance visa,within 6 months you get married and she applies for settlement visa.She will not be able to work while on fiance visa.
    2.She goes back to US , you go with her and marry over there.She then have to apply for settlement visa.Would take few months , but she could work from the moment she sets foot in the UK,once visa is granted.
    3.You can marry in the 3rd contry,if that is easier for you,but again she would have to go back to US , apply for settlement visa.

    I am afraid but the way things are at the moment she can not marry you in the UK.
    What sort of qualification she has?Maybe she can qualify by other means!?
    SO,

    "In order to qualify as a husband/wife you must show that:

    you are legally married to each other
    your husband or wife is living and settled in the UK, or is being admitted for settlement at the same time as you
    you both intend to live together permanently as husband and wife
    you have met each other
    together you can support yourselves and any dependants without help from public funds
    you have adequate accommodation, owned or occupied exclusively by you, where you and your dependants can live without help from public funds
    your husband or wife is not under 18
    You will be allowed to stay in the UK and to work for two years at first. Near the end of this time, if you are still married and still intend to live together, you may apply to stay in the UK permanently.

    If you and your spouse have been living outside the UK for four years or more, you will be allowed to enter the UK a for an indefinite period.

    To qualify as the fiancé or fiancée you must show that:

    you plan to marry within a reasonable time (usually six months)
    you plan to live together permanently after you are married
    you have met each other
    there is somewhere for you and any dependants to live until you get married without help from public funds
    you and any dependants can be supported without working or having recourse to public funds."

    The simple way out is to get married outside the UK first.

    I gather that the UK marriage registrars are supposed to report non-european nationals planning to marry european nationals before the marriage happens. Presumably immigration then turn up and deport you.

    Once married, just apply for a european residence permit in the UK. Your new wife doesn't need a visa to come to the UK for up to 90 days (or perhaps 6 months) therefore she can apply for this permit after she gets to the UK.

    You deal with the european section in Croydon for this. Big plus points are that 1) it's free 2) it's non-discretionary (ie they can't turn you down) and 3) once the application is in, you can work & live in the UK straight away.
