    Hi to all of you here.

    I a Non-EEA (Afghanistan) family member of an EU national (Czech Republic) here in UK. My wife and I are self-employed, married in 2002 and have residency permit for 5 years (issued in 2004).

    I was refused asylum in 2004 which I applied in 1998 (luckily in 2004 Czech Republic came into EU and we got residency permit). At the moment I am just a NON-EEA family memeber of my wife.

    In short I do not have any passport or travel document. I applied for passport from Afghanistan embassy in London and got refusal letter that I do not have enough evidence to prove my nationality :cry: and the HomeOffice in UK refused my travel document application that I do no fall under any criteria for the travel document.

    I do not know what to do as I am stuck in here UK for the last 7 years and want to visit with my wife to Czech Republic this Christmas just for the change.

    Any little help here please.

    Hi there,

    You should try to get Afghan passport,if that is not possible your only choice would be stateless person travel document,passport,which to my knowledge IND can and does issue.Sorry I dont know the criteria for these travel documents,passports.

    The 1954 UN Convention defines the term stateless person as " a person who is not considered as a citizen by any state under the operation of its law" And Article 12 of the Convention states that "the personal status shall be governed by the law of the country of his domicile or if he has no domicile, by the law of the country of his residence."

    Let me see if I got you right.
    You are saying that I should apply for Stateless :eek: Person document on the fact that I am unable to prove my nationlity and my own national embassy.

    Will the homeoffice consider me a Stateless person now if I make another application.

    What Iam saying you do not have many options,unless you want to wait!

    You can obtain Afghan passport !
    OR,
    If you can not prove your nationality what other option you have .IND will issue 2 documents.One is for recognised refugees,I have seen one,good friend of mine had it few years back,red travel document,looks like passport,or stateless person travel document.Follow the link I already gave you , these people maybe able to help you.
    To answer your question,if you can not prove for whatever reason your nationality,I would advise you to go for stateless person.1954 UN !

    Please check with them, talk to few people see what they say, I might be wrong .

    Hi again

    I have been trying invain getting the travel document from the HO.
    I managed to get the Afghan passport atlast.
    I traveled on it to and did not have any problems getting back to UK. the passport was not even stamped. I took the paper (ICD.0052 document) with which has the stamp and got back with out any problems.
