    I know that you have been waiting for so long for your residence permit, and now I am sure your passport will be sent to you very soon, or has it been posted back yet?
    Congratulations on your visa, so YOU CAN DEFINITELY PROVE to your employer that you are entitled to work!
    Some people get the residence permit in another piece of paper, apart from the passport. And this is no problem at all. You can travel with it, etc etc.
    The cases I know, the person got it in a paper cause the passport was nearly full (i think that the Home Office wanted to save a page for the person, hehe) and the other was was another dependent of EU citizen.

    Really, I would recomment to you before sending the passport and documents back to the Home Office, I would recommend you to geta bank account (if you still hasn't got one), get the national insurance number, etc. Really! Get all of this BEFORE you send back to the Home Office, otherwise you might stay in this limbo for a few other months.
    Your employer will accept it!!
    Did you also get a letter from the Home Office?
    And hey, at least now you have a residence permit, so if the employer is not satisfied, then can always call the Home Office ans ask details about it. But now the things changed and you really have "an acceptance" from the Home Office, which is much better than you just telling you are married to an EU. Now you are officially resident here and got your EU right recognized. So your employer cannot get suspicious, really!
    If you want to see the model of the letter I sent to the Home Office with my passport back for them to correct, and the letter complaining, just write me an email or give yours. Mine is glaucool at hotmail dot com.

    So for those interested in timing, our application took a total of 10 weeks to complete:

    14 Sept: application received by Home Office
    7 Nov: application approved;
    16 Nov: EEA residency permit issued; Non-EEA residency document letter stamped
    22 Nov: residency documents delivered and in hand

    Good luck to all those who are still waiting!!!! Hang in there.

    congratulations kjfaughnan!
    I have also applied for UK residence in September.I received acknowledging receipt of my application on 14th September and and haven`t heard form Home Office since.
    I check IND website everyday,but for past 4 weeks they say that they are working on applications submited in September 05.I`m getting realy worried because I`ve already booked X Mas tickets to Poland,and there is visa to sort out(this takes obout 4 days). Our solicitor contacted them 2 weeks ago but no news yet...
    Wish me luck!!!

    Hi,

    Thanks for this post it is good not to feel alone. But i am now stressed to see all the docu;ents some people are sending.

    I am french and my husb is Tanzanian and we sent passports, mariage certificate and letter from my employer......that's it ! Was it not enought ?

    The thing also is that I am working in London but paid in France because I am employed by the french government abroad .... so I don't have National Insurance number. could it be a reason of refusal or delay :(

    we sent our application on the 20th spetember, but no answer yet.

    It is me again :(

    I am going often to the IND website and before they where saying they were considering european applications of septembers and now they are saying they are considering the ones of August :eek:

    Are they often playing with their website like this ?????< :x

    I am not surprised at all!
    I don`t really believe to what they say on that website anymore.when I applyied in September it was saying that they were working on applications from May 05,later it jumped straight to August,quickly followed by September.
    Waiting for any news form IND I check this website everyday and sometimes it says that it currently takes 2 months,sometimes up to 6 months,and other times they just advice you to check their timetable...
    Anyway... the website you were looking at is not realy up to date because the EEC1 form is no longer valid.They presented new EEA forms instead( and that was about a month ago). :confused: Their server is very busy and slow...
    I really can`t wait to hear from Home Office as well.We have been waiting since 9th September 05.lets wait and see what it`s going to say tomorrow.that`s all we can do.wait and wait.... ;)

    We also sent passports, marriage certificate, letter from employer....we also included some pay slips but I don't know if this is required. If they haven't asked you yet for further information then they probably don't need it. I just looked at our application, and I don't think we included my husband's NIN and he may not have had it yet- I don't think you need an NIN for the application.
    Also, about you being employe in France: Well I don't see how this could make a difference- you still need to live here in the UK for the job and so does your husband.
    Have you spoken with anyone yet at the Home Office and asked them your questions? To ease your mind you should call. Call in the morning and speak with someone on line 2- they are more helpful and have better information. Also, if your application is close to being sent out to you they may drop you some hints! Otherwise they will say it is "under consideration" but don't despair, they still could have approved all of your stuff. They say "under consideration" even after one has received a decision!

    I have a question as well.Doesn`t it say on the acknowledging receipt of application from IND not to ask them about progress of ones case?and that`s what it says on IND website:
    `Unless you need to tell us about a change in circumstances (eg change of address or a different Representative), or to ask for urgently needed documents to be returned (such as your passport for urgent travel), there is no need to telephone or write to us about the progress of your application as this diverts resource form caseworking. `
    Our solicitor sent them a letter over 2 weeks ago and still haven`t received any answer.Do you think I should give them a ring myself?

    looking at all the messages .... everybody says that it is better to call and keep an eaye on what is going on !

    anyway i stayed a long time before doing anything : afraid to lose my chance but now it is too much and I feel i need to call. I did a first time this morning and the guy was nice.

    when did you sent your application ?

    I sent my application on 9th September.I am getting really impatient now because I want to take my husband to Poland for Xmas(i already got tickets). :x I don`t know if I can give them a ring because we sent our application with my husbands solicitor( who was looking after my husband for 2 years,and helped him get family permit)therefore I haven`t got any reference number or recorded delivery No(which I think you have to give them before they`re able to access any information about the case).and even if i call they will probably give me their usual answear: under consideration.the solicitor said there is no point keep asking them or sending more letters :confused:
    I`ll wait till next monday...and then may call IND ;)

    Don't worry about numbers , if you give your name and date of birth they can find out.

    But it is true they will probably give you the usual answer...under consideration !

    Like you still waiting I think I will send a fax again soon, because I asked them a letter explaining they have our papers because confirmation of receipt is with my name only....and I need an official paper showing passport of my husband is there .... but 3 weeks after nothing ! :x

    I hope that people don't leave the forum as soon as they've got their permit, but they enjoy coming back for other reasons, tell about their experience or post other topics! :lol: Look at Triple H, he's still here ;-)

    Six month rule

    To make you feel better, should tell you that in other categories like ECAA people are waiting for periods longer than 18 months, so Magdalena don't worry you permit it should be issued before the sixth month under the EU Rules(check my previous post)
    Minimum Period of expectations is 6 Months…afterwards you can try the Parliamentary Ombudsman or EU Ombudsman as well as HO Complain Unit and your MP.

    "1.4 Six month rule
    Article 5 of Council Directive 64/221/EEC requires us to decide applications within 6 months of the date of receipt of the application. Every effort should be made to do so, particularly where an applicant draws our attention to an alleged breach of this requirement. Failure to comply with this requirement leaves the Home Office open to a claim for damages. It does not mean that a residence permit is deemed granted after 6"

    hello everyone! :D
    It`s been my lucky day!
    My husband and I both had a good feeling today. We decided to call our solicitor. She wasn`t in her office at the time so we called Home Office instead. They said the case is still under consideration but on monday they sent a package to our solicitor address.30 min later solicitor phoned us with good news.We got our resident permits and we can go home for christmass.Of course they had to mess something up. They forgot to send my blue card (my residence permit), but the most important stamp was there, in my husbands passport:) And why did they tell me that my case was still under consideration if documents were ready and sent 3 days ago?Nevermind:)
    Over all it took 12 long weeks...
    I feel so happy!It`s my lucky day-i`m going to play lottery tonight:)
