✎ EN Help!! Denied my right under EU law

    What do I do?
    I am a non-EEA citizen married to EU citizen in Uk who has permanenet employment
    I have been looking for a job for four months. Now I just got the offer but they won't hire me until I have the residency permit in my passport.
    This is not legal!
    I cannot wait until I get the permit back from the home office, and I don't think I should have to when EU laws says family members have the right to work. Personnel say because my EEA family permit is expired I don't have the right to work here.
    Do I have to hire a lawyer?

    If your UK spose was already employed, then you should have filed for EEC3 to get residence permit, which technically gets rid of your EEA family permit expiration date, and is taken over by the date son the residence permit. Because you are married to an EU citizen, your right to work is inherent from the fact that you are married, and thus need no permit.

    You have to file for that EEC3 NOW. I'm not sure if you can file for that with an expired family permit. Call the Home OFfice and see what they say.

    Yes, we have already applied for residence months ago, before the EEA family permit expired.
