✎ EN UK Citizen wants to live with Australian Boyfriend

    Hi,

    This is my first posting and I could really do with some advice. I have been in a relationship with my Australian boyfriend for a couple of years (I don't know how you prove this) we met whilst he was here on his UK work visa. When it ran out he left and went home to Australia he is now currently living and working in Sweden with a swedish work visa. Ideally he would like to return to the UK and live and work here but we are unsure as to how he can??

    If that is impossible we would like to either moved together and live either back home with him in Australia or in another country altogether like S.Ireland.

    We are at a loss and I know I am asking a lot of questions at once but if anyone out there knows what rights we have if any could you please reply I really do not know where to start and this is the first site I have come across.

    What you need to do is prove that you have been 'living toogether' with your bofriend for over 2 years. If you can do this (5 or more documents, rent slip, bank account, council tax forms that have his name or your name at the same address) then you can apply at the home office for a common law visa (defacto visa). It would give him a 2 year right to remain in the uk and can work in any company. If you can not prove that then it would be difficult, unless he can go apply for a highly skilled visa for the uk. These are his only 2 uk options. unless i think you can get a year work visa for australia or you could even try for a highly skilled visa for australia.
    Hope that helps (i am on the defacto visa atm and its been great to stay an extra 2 years in the uk)
