    Hi,

I arrived in the uk december last year with my EEA Family Permit. It will expire in november this year. I just realized that I need to apply to the EEC1 to get my residence permit but neither my husband or I can be without our passports for more than a week (I travel for work for training outside the uk every week).

    Questions:

Can I re-new my EEA Family Permit in my country (since the process takes just 1 day)

My permit expires exactly the 22nd november. I will be re-entering the uk from a business trip the 28th of october and then I have my 2 weeks vacations to go home. Can they not let me in since it's close to the date it expires ?

Since I will have those 2 weeks, if I apply for the ECC1 instead of going home do you think I can get my passport back before the end of the second week? (I need it the following week to travel).

Thanks in advance to anyone that helps me,
    Itza

    Itza,
I am in a similar position as you. My EEA Family Permit expires in October but I need to go back to the US and bring back my pets after it expires. Applications for residence supposedly take up to 6 months. My husband also needs his passport to travel frequently for work. I am thinking of reapplying for the permit when I go back to the USA. I will be there for two weeks, but last time the permit took just a week.
Will it matter if I am not traveling with my husband back the the UK?

If your husband is in the UK, then it's okay to re-apply for the EEA Family Permit, but you might have to check the option about meeting your spouse here, and not accompanying, since you're not travelling together.

All in all, you should be fine.

    Hi kelly!

I have travelled in and out of the uk many times this year and it depends. You are supposed to have papers with you to prove that your husband is actually living in the uk (ex. bank account, last pay, your marriage certificate, utilities bill, etc.). I've never being asked any of this but I always carry all this papers with me (just in case, you never know). They usually just look at me and ask me where is my husband (as plain as that), and I answer he is home and they stamp my passport. I don't believe you should have any problems as long as your husband is in the uk.
My question is, can we actually renew the eea family permit? Have you done it before? I'm worried that they say something like we can't because we are already living in the uk.

    Regards
    Itza

I have re-read your posts, and jsut realized that it was not mentioned if your spouses are UK citizens or EU citizens. Nevertheless, if they are here and working, if they are EU and not UK citizens, then I'm thinking you're waiting for the 12 month period to be able to file for residence permit, which actually takes over the EEA Family Permit once it expires. And the non-EU spouse has to file EEC3 form in this matter for the residence permit, not EEC1, as this is for the EU citizen to file to gain rights of free movement based on the fact that the non-EEA spouse is employed and that the EEA spouse claims "self sufficient person".
