✎ EN Family permit extension? UK

    I have a family permit which expires in August. I have been living in the UK for 12 months now. I have a non-citizen passport of Latvia, my daughter is working in uk and has a citizen of Latvia passport which allowed me to get this family permit. (6 month)

    can I get an extension to this permit that expires next month? if so which form and where do I send it to.
    The web site only shows applying from country of origin, yet I am living in uk. Will this extension be for 1 or more years.
    I intend to marry my partner who is a British citizen and is fully supporting me.

    EU Law allows EU Citizens with a Permit to bring their families in the direct line of descendant (grandmother, parents and children) into their host country.

    Since your daughter is working in the UK , this automatically qualifies you to have a Residence Permit in the UK. Technically you don,t even need a Permit to be in the UK since you have automatic Rights to it.

    But for the sake of convenience and officialdom I suggest your daughter makes an application on your behalf on a Form EEC2. You shouldn,t have any problem except the patience to wait a few months for the Permit to come through.

    Thanks for your reply.

    Problem is I am going on holiday in August outside EU and return to UK just 1 day before the EEA family permit expires.
    Cannot afford to send in passport before holiday in case of delays etc so I want to extend this family permit, then at a later date apply for residency.

    So for now I am looking for correct address and correct form to fill in to extend this family permit. Of course the web site is clear as mud.
    Some one somewhere must have been in the same position :?:

    Any help would be appriciated

    I think the form to be used is EEC1. EEC2 is for settlement purposes and the applicants need to have recieved a residence permit and have lived/worked in the U.K. for 4 years.

    Alternatively I think anglulacis can get married wth her British partner first and apply for a spouse permit. But to get married in the U.K. with her current status, she will need too apply for a certificate of approval.

    So to compare, applying under EEC1 is free, but it could take quite long (6 months). But there is no worry. During the 6-month waiting period period, the applicant can stay in the U.K. legally. Applying for a spouse visa is not free, plus you will need to get a certificate of approval to get married first, but it may take less time altogether.

    Just realized anglulacis posted her reply at about the same the as I did.

    I don't think you can extend your permit and get it back before you travel. By law the Home Office cannot charge EU applications, and so I think they put very little resources in it and it is currently taking very long time for them to consider each EU application.

    Technically you can just go on holiday. When you come back, you send your EEC1 application immediately. As long as you submit your application before your permit expires, it should be okay. EEC1 application can only be submitted by post, not in person. So you really need to have prepared everything before you travel, and then send your application on the day of arrival by next day special delivery or courier. During the period they consider your application, you can stay in U.K. legally with the status you had when you entered the U.K.

    However, there is a danger that you may have a problem entering the U.K. after your holiday on the day before your permit expires.

    I cannot wait 6 months either, as I am visiting my mother for 5 days in October and need my passport, a 6 month wait for return of my passport is not acceptable at the moment, flights are booked.

    This is why I want a Family permit extension. I was told this by the British Embassy in Latvia, it would be ok for a further 12 months done in UK after the initial 6 month permit expired.

    So back to the what form? address to send to?

    Yes, it is possible to extend your permit. I phoned the ukvisa (part of the home office) before, according to their answer, you need to apply for an extension with the Home Office. Why don't you ring them up and ask? I still don't think you can get your extension before you travel.

    Thanks to all and daphne for all your posts ,

    I had already emailed various depts including ukvisas, waiting on their reply. However I will call them as you suggested, bet they get lots of email inquiries!

    I expect we will have to hand post when we arrive at Heathrow 8pm day before expirary (after holiday) so all info/application form etc will need to travel with us.

    Phoned Ukvisas (0207008438) all lines busy but automated answer states they only deal with applications from outside UK, it did give me the IND number (08706067766) again all line busy.

    No immigration officer will prevent a Latvian Citizen from entering the UK to look for work. Any questions at the airport attracting a reply that you are looking for work is enough to let you in.

    Alternatively if in doubt just reapply for the entry permit at the British Embassy in Latvia whilst on a visit to your mum.

    You only need to worry if you send off your Passport to the Home Office in London where it will be placed in the long queue at the EU Dept.

    Try to call the IND. I think it is the IND which can extend your permit (this is what ukvisa told me). Try calling continuously. If you hear a female voice, hang up and try again immediately. Usually after a few trials you will hear a male voice. Then you can wait to be diverted to the right person.

    Coyan-- I am not a Latvian citizen, I am a non-citizen of Latvia known as a Latvian alien passport. This is a anomoly with the Latvian goverment (and against EU rules I am sure), I was born there but my parents were Russian I have to take a citizen test to get a Latvian passport proper.

    Anyway I actually got hold of a guy at IND and he says its a EEC1 form I require.
