    Hello everybody. I hope you can help.

    I am writing on behalf of my friend.
    He is non EEA national and his girlfriend is Slovak.

    She has not registered yet for the worker registration scheme but is planning to as she is working.

    Her boyfriend came to the UK on a visit visa and then applied for a student visa but was refused. He has now appealed against the refusal but the Home Office are taking ages and nothing seems to be happening.

    He wants to stay in the UK and wants to marry his girl friend but because of the new rules about marriage they can't do that. They are considering getting married in Slovakia and then he'll go home to his country and apply for a family permit to come back.

    The problem is that his Slovak girlfriend is now thinking of studying.

    So the first question is:
    Can a Slovak bring their non EEA spouse over to the UK before they have registered on the worker reg scheme?

    Secondly, the fact that he was refused further leave to remain in the UK - will this mean he may be refused the family permit?

    Also, if she goes for leave as a student, does she still need to apply for a worker registration card?

    And, can a student apply for permanent residency after 4 years on form eec2? as I heard that they probably can't.

    How long would the residence permit last if she did become a student?

    Finally, what would their best bet be?

    Best bet is to decide what she wants to do first!After that I can answer your question.
    ;)
    If she is studing in UK she would have to produce bank account statments that she can support her husband,and accomodation has to be provided.I can imagine £10000 would be suficient.
    If she wants to work she has to provide contract of employment,payslips and accomodation details.
    If he applies from Bratislava with her that would make sense.
    Either way they have to get maried first,and after that she has to go thru lots of red tape.

    Thanks for your reply.
    She wants to study.
    Her boyfriend is prepared to leave the UK and marry her in her country.
    Then he'll go to his country to apply for a family permit.

    But he'll be the one supporting her as he's got more money. is that ok?

    Secondly, the fact he was refused a student visa in the UK (through no fault of his own) shouldn't harm him right?

    Also, once he gets his family permit (hopefully) does he need to apply for anytyhing else in the UK?

    I dont know all the answers , but her situation can be easy or tricky it all depends on circumstances. She may find some answers in the link below.Regarding his refusal,all depends on the person dealing with him at the time of applicationbut but it should have no influence .All info here:
