✎ EN Eu citizen wants to marry non eu citizen

    hi,
    i'm an eu citizen (french) and my boyfriend is south african . does my boyfriend will benefit from the same rights as i do to live and work in the E.U if we get married in south africa ? or do we have to get married in france or any other eu country for that ?
    my second question is the following : 13 years ago my boyfriend made the mistake of getting married, uk authorities found out it was a fake marriage and deported him .
    can he still go back to the uk after being married with me ? or does it mean he's personae non grata over there for ever ...

    If you are economically independent (with the offer of a job or evidence of sufficient funds) your husband is legally entitled to accompany you to any EU country within the Union.

    From the day he was deported, he would be banned from re-entering the UK for 5yrs. 13 yrs is long enough for him to had paid his dues to the Queen and is legally entitled to reenter.

    Bringing the argument from another dimension, EU laws overide national laws so if even he were to had been deported yesterday he wouldn't be rentering the UK based on his own rights but on the wife's Rights as an EU citizen. In such a case your EU rights overides that of the interest of the UK govt and his deportation and personal UK immigration history is of no relevance. (Except in a situation where the deportation is based on Public Security, Public Health and Serious Public Disorder)

    just one more thing , when you say that my husband would be legally entitled to accompany me to any eu country , does it also mean he would also be legally authorised to work there ?
    would you know by any chance what the amount of sufficient funds i will need to have in order to show i can support both of us ? or maybe a website where i can find this information ..

    He will be allowed to work soon as you can claim Economic Treaty Rights in the UK. Its advisable after marriage to secure some sort of employment in the UK and then get him to join you.

    Alternatively if you have enough funds (Euros25,000 and above) to prove that you and your spouse will be self-sufficient without becoming a burden on the Public he could be allowed a residence permit. His entitlement to a work permit is subject to lots of uncertain discretion by the immigration authorities as to what suffices for self-sufficiency and what are the possibilities of you getting a job for him to work. This alternative comes with a lot of uncertainties . If you can avoid it go for the first option. Lots of jobs to pick up in the UK to satisfy your claim to Economic Treaty Rights.

    As it stands you have to marry before you come to the UK ,your husband can enter UK on family permit,which would allow him to work.If you do not have job in the uk , sufficient funds will be needed.How much that is?I do not know, that is very grey area of EU/UK immigration.You may not even be asked to produce that.As long as you have some funds I think that would be OK.

    To enter UK I do not think that funds would have to be great! They would probable get 6-12 months family permit for him.Once in the UK after she got the job it would all be formaility.
