✎ EN Spouse Visa

    Hi everyone,
    I have just been on Google for a little while trying to find more information about my situation.
    Me and my wife, who is American, are currently living in France but we are wanting to move back to England as my current job will be coming to and end shortly and she is recently self employed so can easily move. I have a house in England so we thought it the most sensible next step.
    We are currently applying for her Visa and noticed that I need to have proof that I have an income. Currently I do not have a job in England and therefor have no such proof. At this point we are a little bit lost in what to do. We will have our savings but for this type of Visa do I have to have a job for us to get her the visa?

    If anyone has been in the same situation or has any advice for us that would be great if you could advise us at all.

    What is your nationality ? The type of visa your American wife would need depends on your nationality.

    If you have lived and worked in France for more than 6 months, you can apply for EEA Family Permit for your wife which is issued for six months and later in UK ( as long as you and/or your wife has a job or sufficient funds to support yourselves ) can be renewed for a five year term.

    You can of course apply for spouse visa for her under the UK immigration rules but if you have lived in France for more than six months, you are also entitled to be treated as an EEA national. If I were you, I would go for EEA route because its much simpler, quicker and free.

    You don't need to have a job in UK as long as you have enough money for a period of three months ( there is no mention of this time period anywhere but this is kind of unwritten law to have enough funds for three months to be on the safe side ).
