✎ EN Marriage Visa

    Hi

    Well all of this is very confusing for my small mind! I am a UK citizen and met a chinese national in London 2 years ago, and we have been together ever since. She did however have to go back to China 4 months ago (unfortunately having overstayed her visa, although she went back voluntarily without detection as far as I am aware).

    We plan to marry in China in September, and I would like for her to come back with me straight away but don't know if this is possible? Are we able to apply for a marriage visa prior to marriage if we provide proof after the vent that we have married?

    I know that we have to prove various things as I have seen in earlier postings, but it seems crazy for us to marry and then have to apply for a visa afterwards. I can only be in China for 2 weeks when we get married so I can't hang around so would have to go back to UK alone if all else fails and get her to join me later.

    Is there a way around this? And does anyone think there will be a problem because of the previous overstay?

    I have independent means to look after us, have my own house and good job so I am hoping all is ok on that front.

    I would really really appreciate some advice here is anyone can help????

    There is no other way,everybody has to go through same process .
    Regarding her overstay,may or may not have implications.
    Depends how long overstayed,worked or not,etc...
    On the paper it should not make difference,but in practice....sometimes does!!!

    Thanks very much for your reply.

    She overstayed for one and a half years - so that's not good, but given she wants to come to the UK for keeps it seems daft that that would be a problem. If we married and they wouldnt let her come to the UK, is that likely? I hope not, as i am worried now as i dont know what i would do then.

    Does anyone know if is a problem if i am not there when we apply for marriage visa? I have to go back to work so am only in China for 2 weeks. Can I apply in the UK for the VISA for her?

    Also how long does a marriage VISA take to get?

    Sorry for all the questions!!
