    Hi ALL,

    After having a residence card for 5 years, in the event of breaking down of marriage (marriage between EU nation and non -EU nation),MAY non eu nation loose his/her right to stay and work in the UK?

    If you have been married for 3 years, and you have been living in the UK for at least one year, you should qualify for retention of right of residence. Since you are no longer dependent on your EU spouse, you also need to be exercising "treaty rights". This usually means you are either working or very rich.

    tank you for your prompt reply.what if non eu nation has been married to eu nation less than 3 years and they live for 1 year in the uk.

    There are a few other options (custody for a child, victim of violence in the relationship). You probably want to talk to a lawyer about these.

    If none of these options apply, you would have to apply for a visa under national immigration law. You generally have to do that in your home country.

    I would like to ask how is calculated 1 year living in uk? If my husband (non eu) was living in uk on Family Permit visa from April 2007, and from August 2007 had residence card (we were applying EEA2 form). From which date will be calculated this one year? From April?
