    I've posted on here before - basically I'm a French/UK citizen, with both passports, living in the UK, studying for a PhD and working part-time. I'm flying over to the US in September to get married, and want to bring my partner back to the UK (he's a US citizen) to settle and work for a couple of years. To apply for the EEC1 thing, can I apply from the UK while he's in the US, still working and saving up? I'm asking this because there's no way he can come over and not work for four/five/six months while waiting for the paperwork. And does he have to apply for the EEA family permit thing from a British Consulate in the US before he can come over/before I can apply for the EEC1? I'm not sure what the procedure is and could do with some advice. Thanks...

    HI Alabama,

    I can probably help you out a bit on the info part as I just left the US to be here in London. Reading your query, here is what your steps are likely to be:

    1. Go to the US and get married, and then get a certified copy of your marriage certificate from the Judicial Court from the city where your partner lives.

    2. With that marriage certificate, your partner should now fill out VAF1 form to apply for the EEA Family Permit, which is used to accompany EU citizens into United Kingdom. He will need to submit financial docs (I submitted a letter of employment signed by my company's human resources/payroll department and a letter of certification from my bank that I have several bank acounts in their bank). This will prove that your partner is not going to be a "public charge" to the UK government and has funds to support his stay here. Since you are employed (and I assume you'll just file for a vacation to get married in the US), then this is not even a concern for you guys anymore. Also, he will need to submit his passport, your passport (to check the identity of the EU National), and 2 color ID photos (on plain background - size 45mm x 35mm).

    3. You have to write a letter as well stating the intentions of wanting an EEA Family Permit issued to your partner. You might want to mention there that he has enough funds to support himself when in the UK, and also that you are gainfully employed and will be able to support him once in the UK. Again, this is to reiterate to the UK Embassy that issuing that EEA Family Permit for your partner is okay and that he will not be a publich charge to the government.

    4. Put all of the above in an envelope from either UPS or FedEx, with another envelope inside (prepaid) for the return of the documents back to your partner's residence, but now his passport will have the UK Entry Clearance sticker (much lke the US Visa sticker on passports), and it will state there that the "visa" type is VISA EEA Family Permit: Family Member.

    Hope all of this helps. It took me and my wife some time to streamline the info like this, but hope this helps. :D

    Thanks for your help - it actually sounds feasible for us to do!!! We're currently saving up to be able to give it a go. Were you able to work straight away in Britain with the stamp in your passport?

    Yes, I was just on the phone with a caseworker from the IND, just before posting this, and he confirmed that with the EEA Family Permit stamp in my passport, I can seek and/or accept employment.

    Now I'm off to start looking for work! Good luck to both of you! See you in UK!
