    Am married to a german citizen who has been in the uk for nearly five years. My wife is not working at present because she is on maternity leave and receiving maternity allowance.

    We applied for EEa2 hence am non eu citizen on july 26 2008.

    My wife was made redundant b/4 we applied for EEa2 Card.

    We got a letter this morning, to send evidence that my wife is exercising treaty rights in the uk.

    My question is can someone who is in receipt of maternity allowance be regarded as someone exercising treaty right in uk.?

    Am sure ur answers will help.

    I don't see why not. After all, she has a job, and she is only temporarily not exercising it.

    Hi there,we are in the same situation as you.
    were married and i am irish and am 6 months pregnant and going to have to be on maternity allowance and therefore housing befefit as my employnent was temporary and not goin to pay anything.

    Have you applied or heard anything back at all on how to go about getting eea2?
