    Hi

My Wife and I recently relocated to Scotland, from South Africa.
We are both South African, but I am also a Swiss Citizen.
We are allowed to live & work in the UK based on my Swiss Citizenship, although my wife's permit needs extension.

She has an EEA Family Permit which allows her free movement within the UK for 6 months.
I would like to submit an EEA2 application form, which should allow her to stay in the UK for another 5 years.

As far as I understand I will need to prove where we live in the UK, our income and marriage.

Since I am working and have settled in Aberdeen, I feel that this should not be a problem (currently in my 1st month of work).

I am a bit worried about submitting the application end of March (once I have pay in bank account), and it not being processed until after current EEA Permit expires (end June 2007). I went through a very rigorous exercise back in South Africa to obtain the 6-month EEA Permit for my wife. So essentially timing of application, proof of enough income and proof of marriage being a concern (since we have only been married a year and my wife’s name was never on any of my leases).

If you can assist us please let me know what you would recommend.

    Many Thanks

What you need to submit is your proof of employment (employment certificate/contract, original payslip, or both), proof of residence via your utility bills (ideally both names should reflect in the bill). You do not need to submit bank statements so no need to wait till end of March to submit the EEA2 forms.

Also, you do not need to worry that it might not be processed when the current family permit expires. What is important is that the EEA2 forms are posted at least a month before the current permit expires. When the forms are with the Home Office, you can stop worrying about "your wife being out of status by June" since you submitted your forms before it became expired.

Read my sticky about submitting these forms and the preparation you can do.

    Hi

I have read up a few of your posts on this site, including your sticky - very informative. I am wondering on a few specific things (that I haven't found mentioned here). Firstly, I am working as a contractor for a company, through an agency but also through my own Ltd company as well. Works like this (me-->Ltd Company-->Agency-->Client).

The only employment "contract" I have signed is between myself and the agent (with the agent being bound to the client). The contract I did sign states that I am actually working for "xyz Ltd". Overall, this may make the situation appear a bit more complex to the HomeOffice when regarding my EEA2 submission.

Since my Ltd Company was setup for me by my Accountants, they are my acting Company Secretary also (with their own payroll department). As a result my Ltd Company's address is the same as my Accountant's address - which is London (and not Aberdeen where I have a lease for a flat).

If I submit the EEA2 form would I need to fill in section 5 (self employed) or section 4 (employed)? Technically I am "employed" by "xyz Ltd" and I have proof of this in the form of a letter from the Payroll department of my Accounting Firm.....eg. "Damian is employed by xyz Ltd as a fulltime employee, since xx-xx-2007...regards, Payroll Administrator (signed)".
They will also be sending me salary slips each month end stating the same.

Would this allow me to consider myself as "employed" and thus fill in section 4.....or would I have to fill in section 5?
....because I have no way of proving I have a lease on my "premises" (5.2 on EEA2 form) since my company's address is registered to my Accountant (who are also my Company secretary) and not me.

    Thanks
