✎ EN Which one is better? Residence Permit or EEA family permit.

    Hi all
    I am non-EEA natioanl married to EEA national(Czech). and live in UK

    Well in short, We have Residence Permit issued on 8/10/2004 for 5 years.

    My wife was issued with a residence permit CARD and as I did not have my passport with me that time so I want issed ICD.0052 document with just a Residence Permit stamp on it. And was advised when I get a valid passport I should sent it to them (Croydon) 2 months before travel and they will stamp the passport to show my immigration status.

    I sent my passport on 22 april 2006. and I received it today after 2.5 months with no stamp what so ever.

    I have been told in a covering letter, "Wishing to return to UK should apply for a EEA family permit from the british diplomatic post abroad before entering UK again. EEA family permit is issued FOC on priority basis"

    Now what happend to those EEC form?
    The new EEA form are issued from 30th April but I had sent my passport on 22 april.

    By the way I want to visit abroad, REAL SOON, and do not know what to do.


    Do I have to apply for EEA family permit now even though I still have that ICD.0052 form to prove my immigration status?

    What happened to your passport that time?
    Did you go home and get that one?
    Why did you apply again nearly 2 years later!!!?
    Where do you come from/do you need visa to get into the UK?


    Family permit is for the people applying outside UK.

    I am from Afghanistan. I am here in UK since 1998. I claimed asylum but the application was in process when I married my wife in 2002 here in UK. When Czech joined EU in 2004. I applied for Residence permit along with my wife (on self employment basis) and got Residence permit for 5 year and I discarded my asylum appeal.

    ++++++What happened to your passport that time?

    I did not have any valid passport that time. (could not renew it)

    ++++++Why did you apply again nearly 2 years later!!!?

    I just had my new passport from my ebassy.(there was a problem before. As the Opposition party was controlling the ebassy in the begining)

    I guess that will do.

    Oh, ok....I remember your case now!
    You should be able to get a stamp now.You should write the cover letter explaining situation and maybe to send all other info confirming that you are married to EU citizen.
    Do not under any circumstances leave the country without residence stamp!

    Thanks for the advice.

    I called Homeoffice and they are telling me all non related stuff. Sometime I think they have very incompetent people answering the phone (after on hold for good 30 minutes in my case).

    I even called that "Premium Service" £500 one. But they also won't do it.

    Like you said write to them. I guess again they will let me wait another 6 months with no fruitful answer.
    SO
    FINALLY I called my Local MP just now and as expected he said send me the deatails and I will do some thing about it.

    I have used this MP before and he really gets the answer very quickly from the homeoffice minister. McNulty MP (I guess).

    To be honest as you said never leave the country without getting the stamp, I am doing that since 1998 :)

    I have waited that long. couple of months won't bother me.

    Pray for me.

    I will post the outcome.

    Meanwhile I would not mind any advice.



    ALSO is it a good idea to apply for EEA2 (residence card)? or shall I just wait until see what happens.

    By the way how long it takes to process EEA2 applicatios.

    Hi again

    another question.

    Can a Non EEA national travel on a Residance Permit Card along with the passport or you will still need your passport to be stamped too?
