wanting to work in spain

My British De Facto partner has just been offered a job in Spain, we are planning on moving in about 3 months. We live in Australia at the moment.
But have just been informed that i (a Non - EU New Zealander) cannot get a visa to live or find work without sponsorship from a spanish company. As i cannot get this, it is "impossible" to get a visa.
We were planning on getting married next year, but are now thinking that it might be better to get married before we go.

So would it be better to:
Just go over without a visa (arriving as a tourist) and if in a few months we decide to stay for the long-term start organising sponsorship while im in Spain, i know i'll have to come back to Australia to collect the visa; or

get married before we go over, NZ'ers dont need a family reunion visa, so am i right in saying that i can arrive in spain and go to the police with my documents and apply for a residency card? can i work in spain when i get there?

Hi Becmez,

I think it would be better for you if you get married before coming to Spain, this will make life a whole lot easier for you, believe me.

If you would not ordinarily need a visa to Spain, then you wont need one to enter to process your residency.

What you need to bring with you when coming to Spain are the following:

1. A police report covering the last five years - this must not be older than three months
2. A marriage certificate - this must also not be older than three months.
3. When you get here, you need to register with the municipal council where your husband lives. You will be given a document stating that you live at that address
4. Your husband also needs to get one. Its takes about 5 mins to get, so you dont have any problems.
5. You will need to present a doctor´s report. You buy the certificate at any ´Tabac´store any where in Spain. You take this to a doctor and he´ll examine you and sign the certificate. it´ll cost you 20€

I suggest you employ the services of a ´gestor´ they will get you results faster. They cost between 180 - 300€. Spain is a ´man know man´country, so what will take one person months, may take another days. They cost between 180 - 300€

Be prepared for anything, as it seems things change here all the time. Because you are ´non-communitario - non-EU (even though you are married to an EU citizen)´, you wont be able to get the residence card at the police station. You will need to go to the Óficina De Extranjeros´in your city. There are always long queues, and these are just to get appointments. Waiting time for appointments is usually 2 - 3 months.

All documents have to be translated to Spanish by an official translator. If you use a gestor, they´ll be able to arrange all this

I had a similar problem, except we are gay, we contacted the International Law firm of Attorney de LA CUETARA at http://www.spain-usa.net and this is what he said; "Come, we will get you married and we will get your work permit!!" so he did!!!, and we live here in the Costa del Sol, happy for ever after!!!!
