✎ EN Spanish property tax (iva) problems!!!

    Can you help?....URGENT!!
    I am seeking advice on behalf of group of uk buyers. We entered in to a contract to purchase apartments being built in Almeria Sapin. We agreed in the contract to purchase 'touristic' apartments with an iva tax of 7%. The completion is almost due and it now seems thst the developer wants to charge 16% iva as he states that these apartments are business premises from which we are to earn rental money, we MUST rent them out (even if we do not wish to ) and we MUST rent them through a rental agent appointed by them! Nowhere in the contract or sales documentation is ther any mention that these we to be classed as 'business premises'. In the original sales brochure it is stated..owners can rent if they wish, use the property for their own use, a mixture of the two or however the require.
    Anyone any ideas, would obviously appreciate any help you can give us, especially from anyone expert in this tax situation.

    Hi,
    I am sorry you have came up against a problem with your property.
    You will have to read through the Agreement again all the small print, how did the developer come up with the idea that this was going to be a rental Property and how does he say that it has to be rented by him.
    Is the lawyer ( Abogado ) you are usig in Spain or the UK because you will have to contact him also the person that is doing the Convience ( Notoria ) before you make any final payment.
    I do not know all the ins and outs of your problem, your Lawyer will be able to tell you the amount of IVA you would have to pay.

    You have the same rights in Spain as the Uk as far as Consumors Rights.
    If you type into search engine Consumodoro Spain and then on English and pick the Area you want, you will more than likely get the answers there also.
