Are you applying for ILR (Indefinite Leave to Remain)? In the FAQ section we have a short article about applying. It appears you were refused - correct? The UK Border Agency has official info about applying. I am not sure exactly what you are applying for. Does that answer some questions or what exactly is your status?

Comprehensive medical insurance is required by UKBA in ADDITION to the NHS and sucn an insurance must also include emergencies.

Your way forward would be to argue your way through it to claim that NHS is enough. Some people have done and won their argument but theoratically what UKBA means is that you have to live another 5 years in the UK before qualifying for permanent residence i.e. you can't have comprehensive medical insurance in the back dates.

    One word - Argue !

    Good luck !

    Hi there,

I have a similar problem as tasminka. I am from the EU and applied for permanent residency in January but had it declined because of lack of comprehensive medical insurance for the period of studies. I worked full-time for 4 years and over a year ago I started a PhD. I provided EHIC card with my application as there was an option to do so in place of comprehensive medical insurance but I was advised it could not be used as it is a UK one.

My question is, if I started a part time job now or purchased a medical insurance would I be able to qualify for permanent residency next year or would I have to wait another 5 years? According to the form the medical insurance is only necessary for the period of studies so I understand that the 4 years of work should count and I only need one more year of private insurance, is that correct?

The second question is, how to argue the case? Do I need to appoint a lawyer if I wanted to do so? (According to law all students staying in the UK for more than 6 months are entitled to NHS treatment anyway so the UKBA requirement of additional isurance seems does not really make sense to me).

Finally, can you advise on the insurance that is acceptable by UKBA?

Thank you very much in advance for your help.
