✎ EN Returning to the uk

    My partner was removed from the uk as he entered illegally we have been together for 4 yrs and I am a british citizen, we understand that he has a 10 yr ban because he entered illegally. We are planning on getting married in his naturilised country and he is thinking of travelling to Europe. In order for him to become an EU citizen do i have to live with him in Europe for him to apply for a Family or spouse visa before he travels? if so what would be required of me ie; job, savings etc.

    Becoming an EU citizen would be a long way to go besides of course you would need to be exercising your treaty rights in that particular EU country for him to get a visa.

    Your better bet would be to get married and apply for a UK spouse visa. The 10 year ban, if there is one, wouldn't apply in that case.

    Thanks for getting back

    But i thought that because he came illegally and was removed not deported it states somewhere on the UKBA site that he could not return for roughly 10yrs however if went home voluntarily he could return in roughly 12 months. So our best bet is to apply for spouse visa not to bother going to an EU country where he could become an EU Citizen then eventually get a Visa to the UK which his previous history of removal from the UK would have no relevence beacuse he would be applying as EU Cit??
