    Hi,

My wife is a Chinese passport holder with indefinate leave to remain in the UK, Her Chinese passport is due to expire later this month, We went to the Chinese embassy in London to renew it, but were told by the Chinese embassy that before they issue her with a new Chinese passport and because she has been in the UK for 3 years she will need a letter from the home office to confirm that she has not applied and has no intention of applying for a for a UK passport, which she has not. I have sent various emails to the Home office and UKBA but got automated replies from both with information that does not include how or where to apply for the letter from the Home office which she requires to get a new Chinese passport, it just tells you how to transfer the leave to remain stamp from one passport to another, which is not relevant because she has not yet got a new Chinese passport. Does anyone know what form she would need to get this letter or who to contact who might be able to help. We were planning to go to China in October but she cannot do this until her new Chines passport has been issued. Thanks in advance for any help you can give us.

That requirement of Chinese embassy is absolute nonsense ! You are usually asked to prove that you have applied, not that you have not applied ! I have never heard of such a letter from Home Office !

You should ask the embassy if they could give you a specimen of such a letter ? If its their genuine requirement, which I don't think it is, they are supposed to have a specimen of such a letter which reads what they need to know from Home Office. I would rather argue with the embassy than chase UKBA.

    Good luck

    Hi,

I been in touch with UKBA today and they say my wife needs to get Confirmation of the Non Acquisition of British Citizenship

Here is the link to the information on their website. http://www.ukba.homeoffice.gov.uk/briti ... ou-are-not british/ They also charge a staggering £80 for this, which seems a bit steep just for a letter.
