✎ EN EEA2 - CRITICAL SITUATION - SOMEONE PLEASE GUIDE ME

    Dear All,

    I am a Non EU national married with EEA national. I applied for eea2 card last year. Right from the begining my wife is not worked since we got a 2 year child. I am the only working person in the family. She gone for ESOL courses to improve her english knowledge. last week i got a call from case worker , that my wife has to prove her treaty rights. But she never been worked before. I said she is doing part time english course. So that she told me to provide a certificate from instution where she is studying and she paid the fees on her self. But we are getting housing benefit as well as tax credits. The case worker advised me to get a comprehensive medical insurance, to prove we are not using public funds. I dont know what to do.

    can some had same situation in past , please help us to recover from the problem.

    In your case you are entitled to residence based on that your lady is student. You can provide them with a proof of her studies such as a letter from her uni..etc. If they ask you about health insurance you can use the NHS cover or otherwise you can get private health insurance from many providers.

    Another route is based on being self-sufficent where you provide them with evidence of funds however you cannot be self-sufficient and claim benefits at the same time as the concept of being self-sufficient is not to rely on social security benefits.
