✎ EN EEA2 application. Passport still with me

    Oh and btw i did receive COA straight after i applied for eea2

    Inefficiency of Uk Border Agency is a total disgrace and an endemic problem. Under EU law, Directive 2004/58/EC dated 29 April 2004, Article 10 states:
    "The right of residence of family members of a Union Citizen who are not nationals of a member state shallbe evidenced by issuing a document called residence card no later than six monthsfrom the date on which they submit their application." You may also reference Article 18.2 of the Immigration (EEA)regulations 2006, which specify the same.

    I therefore suggest if you do not hear from UK BA within 6 months of your application that you send an official complaint letter indicating that they are in breach of EU law.

    You may also want to sign my petition to force the UK goverment improve immigration service and reduce processing time to 6 weeks. If I can get 200 signatories the goverment will be force to give a formal response on this subject:

    Eric, your petition only covers EEA4 applications and Elmarik applied for a residence card (EEA2). It would be more successful, I feel, if it included all applications under EU law.

    Just my opinion...

    Hi Plum,

    Well officially today it has been 6 months since they have my application. And noone contacted me reg my passport, which is still with me. So which says that it isnt being considered. And plus my wife's application is also delayed since she is applying for EEA1. We made a joint application. So what would you do if you were in my shoes? Shall i wait, or shall i just contact them? I know that some ppl wait more than 6 months and as they say that 6 months is a minimum waiting period. I am in no hurry as i have work. And my employer is satisfied woth COA HM sent me. Would be nice to go on holidays :)
