    hi all,

    I am a non eu and have been in the uk for 4 years on a student visa.
    for the past 3 years i have been living with my british boyfriend and we are expecting our first baby in 5 weeks, however my visa runs out in 11 weeks (30 November 2008)
    As my boyfriend is still struggling financially, he can not marry me right now (he is on benefits)
    I want to extend my student visa, but i will have a new born baby, and i am not sure on how this will affect.
    If i am refused an extention on my student visa, can i still apply for a certificate of approval? (as i read that the rules have changed from July 2008 and u no longer need to have 3 months left on ur visa)
    does the fact that he is getting benefits will affect our application? could we be refused?
    i am such an emotional wreck at the moment as i am heavily pregnant, struggling financially and risk to go back home with a new born without her father.. can anyone help me find a solution?

    I know this is not very romantic, but marriage would still be a good option. I would never recommend it for legal reasons, but obviously you already have a commitment together, so it is worth thinking about it.

    This should not necessarily be a problem, as long as your progress is satisfactory.

    That may be too late, so maybe you should apply for the CoA now, just in case.

    As long as you have money to pay for your needs, his benefits should not be a problem as such.

    If not: have you considered pausing your studies for a year, and taking a job? That should help a lot with the finances. But you would need to get married and switch to a spouse visa to get the right to work.
