✎ EN US Citizen in UK on Fiance Visa

    I'm a US citizen who has a fiance visa that expires on April 28th. I am now worried since we have done all the registrars documents, postings and are set to marry on April 21st that my visa will expire shortly after marriage.

    I've read through a lot, and know I must apply for either an extension of visa or a spousal visa, but not sure which is correct. I would like to get the documents sorted now so that I can send in my marriage certificate and all additional requirements before we leave on honeymoon. We are not leaving the country, so that is not an issue.

    If someone could provide me a link to the correct information and application process, your help would be appreciated.

    I am not an expert on the national legislation, but I think you have to apply for a spousal visa, which should be form FLR(m). Since this is the standard procedure after having a fiance visa, it should not be too difficult. You will need to include quite a few documents to prove that your marriage is genuine. If you have a shared bank account or shared utility bills, that would be helpful. See the http://www.bia.homeoffice.gov.uk/siteco ... /flr/flr(m) (sorry, you have to copy and paste the link).

    And you have to make sure that you send the application before the visa expires. Otherwise you may be considered an overstayer, and you could be banned for 1 to 10 years.

    Thank you for the quick help! I've used the link and was able to confirm the information you provided with the BIA on the phone. I was told that it would take 4-14 weeks for the Spousal visa @ $395 pounds or same day is $595 but could take up to 8 weeks to get the same day appointment. I was told that as long as I submitted prior to my visa expiring, that I would be ok.
