✎ EN Moving to the state

    Hi!! is it possible for me to move to the state as a Visitor I 94 then apply for I-130 Im Canadian married to American man we want to be together but just wonder if this will work then adjust my status when I get in to the state ..we just want to be legal everything did anybody can answer this please help ..and many thanks..     If you're a Canadian citizen, then you can come into the USA anytime you want. Once in the US, your American husband should file for the change of status for you to grant a spouse visa.

    Hi!! thanks for the reply ...how about when I cross the border should I tell them I will visit my husband? because they saying I cant go to the state if my intent to stay? is that true?? we didn't start the I-130 yet because of that reason .. and he is in the airforce he might go to agfaganistan this coming March but he wants me to be in the state ..how long before they grant you the spouse visa after he file the paper work?? and thanks for the reply really appriciated..

    When you cross the border, never tell patrol officers of any indication you may not return to your home country (in this case Canada) as they will not let you in. Just say you are vacationing and seeing friends.

    Once you're in, your husband should then start filing for your spouse visa, and processing (if complete paperwork is submitted) is usually around 6 months. During this time, once your papers are submitted you will not be considered out of status (as you will pass the 90 day limit).

    you will need to apply for I-130 (marriage/spouse)visa.You will be able to applying for jobs or buying a house( status "legal". :thumbsup:)
