✎ EN HOW CAN I MARRY MY NIGERIAN FIANCE?

    My partner entered the UK illegally approx 5yrs ago. We have been together for two years (we also live together) and wish to marry. My partner entered the UK on a fake passport and claimed assylum. He was instructed to return to the airport the following day, but did not for fear of being deported. Since this time he has been working (fake NI number) and his name is on some of the household bills. We therefore have proof that he has been residing in the UK (illegally) for a reasonable ammount of time and so proving that we are in a committed relationship.

    We know for a fact that if he is deported, he will be unable to return to the UK. I have tried everything so far (that I can think of), to eneble him to stay in the UK and apply for a work permit here - I have spent approx £5000 so far on solicitors fees. The money is not the issue - I am prepared to do whatever it takes for us to be together.

    If he returns to Nigeria and I 'send for him' how do i prove that we know each other without revealing that he was here illegally? I have been told by the home office that this information may jepordise his application. I have argued the point, that he should get merit for returning of his own accord. Apparrently this has no bearing. I am now unsure whether or not to declare this information, if i do decide to go down this route. Can anyone provide any answers?

    I have also phoned the British Embassey in Nigeria for information regarding sending for a spouse- they too informed me that there is no garuntee that his application will be successful for the same reason.

    I am prepared to travel to Nigeria to marry him, but again, do I tell the authorities that he was here illegally?. If not, how do I prove we know each other? Also, how long is this process likely to take. If it is likely to take a few months, i am prepared to leave my job and stay in Nigeria for however long it takes. However, I need to know this information asap in order to plan things properley.

    If anyone can offer any information, I woul be eternally grateful.

    I hope that this helps. My fiance is Nigerian and arrived in the same sirumstances as your fiance. We decided to take the bull by the horns and went to the home office in Liverpool. He arrived in the country in January. We decided that this was the best route for us as we also wished to marry. My fiance had already claimed asylum in Ireland three years ago, which is where we met. He was deported back to Nigeria in July last year. We took legal advice was told that the best option would be for him to claim asylum in UK. When we did this my fiance was detained for three weeks. We went to court and the judge released him on bail for £10,000. He has took the option of voluntary return to Nigeria because if you are deported it will effect your application to return to the uk. We are now waiting for instructions. I am returning to Nigeria with my fiance. We had the blessing from the judge and he hoped that everything works out for us. My fiance has now been given temporary admission to the UK and he has to report once a month to the immigration. Although this was difficult at the time we are now in a better situation because hwe has a reason for bein in this country legally.
    As for getting married if you are a church goer you can marry in the CofE church without home office approval. This is the line that we are following and then my fiance can return to the uk as my husband legally.
