✎ EN UK Guy + OZ girl visa nightmare!

    Hi there,

    Hoping you lot can help..

    I'm a brit, and my girlfriend is an ozzie. We met when she was in the UK on a working holiday visa, but have never lived together as she worked in london, I work up north, and we only met 6 months before her visa ran out, and went back to oz. Since then, we've maintained a commited (although rather expensive!) relationship with rafts of travel, phone calls, letters etc. By the time she came to the UK, we'd have been together over 2 years, but would never have lived together...

    What are our options? She can't get another working holiday visa, and as we've not lived together, does this mean that partner visa is out the window too? Or if we prove a committed relationship, is that good enough?

    While marriage may be on the cards at a later date, we don't feel it's a good reason to go ahead, just for a visa...

    Any ideas?

    Not many options available,partner would be tricky to get,so only fiance or spouse left :(

    OK, so she can't get another WHV and you definately can't get a spouse visa as you haven't lived together for 2 years.

    Is she eligible for any other kinds of visas?

    I'm assuming, since she was in the UK on a WHV that she's not eligible for an Ancestry visa (e.g. if she has a grandparent who was born in the UK). Also ask her if she qualifies for a similar Ancestry visa for any other EU countries - e.g. perhaps she has French or Italian ancestry, maybe she can get a French or Italian passport, thus it'll be a shiny red one and she can come back and work in the UK with no restrictions.

    Failing that, is she eligible for entry under HSMP?
    Have you thought about Work Permit employment (which is pretty hard to get unless she's a doctor or in management or something else specialised)?
    And of course depending on her age she might be eligible for an Irish WHV (and there are also French ones) which, while not being in the UK, would at least put her in a neighbouring country and you could see each other more frequently to determine if you want to marry.

    Also, how old are you? Have you considered going to Oz on a WHV or other kind of entry visa?

    Oh, and of course I forgot the Student Visa - she can apply for this from Oz, and while here although she does have to attend her course she can work up to 20 hours per week...

    So all in all, not really a nightmare, there are loads of options available still I think?
