✎ EN Mercyful law for illegalimmigrant married with EU-citizen ??

    Hi again,
    I am Algerian and my wife is swedish, we get married a year ago here in Sweden, and we live togather in sweden i am in black and i work in black also and my wife is student. Last year after we get married we went to Migrationsverket (immigration office here) they siad to me to go back to my country to make the interview and the decision can take 12 monthes or longer!

    Please which law or religion separates a husband from his wife for a whole year??!!

    We want to know as she is an EU citizen, can any mercyful EU law solve our case?

    Hi

    The Swedish authorities are right. Your wife even though an EU citizen can not take advantage of EU Law under this circumstances since she hasn't moved from Sweden to another EU country to take advantage of EU Freedom of Movement Laws.

    Under the current situation your case falls under strictly Swedish Immigration rules. But if she is for instance to get a job in Denmark with you joining her then it may be possible for you to take advantage of EU Law to secure a Residence in Denmark. That is how the EU system works.
