✎ EN Help needed! French/UK wanting to bring US into UK...

    I met my US partner years ago and he came over in January on a BUNAC visa, which is obviously running out. We went to the immigration advisory centre in Edinburgh and the lawyer told me there would be absolutely no problem going to France and coming back with my boyfriend by exercising my treaty rights as an EU citizen (EC1?) seeing as I have French and British nationality. So I applied for and received my French passport expressly for this purpose and we completed the forms the lawyer handed to us. We haven't been living together for two years but she thought this wouldn't be an obstacle, seeing as it never has been for her cases. I phoned the British Consulate in Paris and they say it's a) for spouses only and b) I needed to apply in advance, not just fill out a form and hand it to them like the lawyer claimed. We're supposed to be flying out to France and back into Britain next week and I really need some sensible advice. All this conflicting info is stressing me out.

    The Consulate is right. An EU Permit is only issued to the non-EU Spouse of an EU citizen. Within UK Immigration rules you have to be working in the UK and married for your non-EU partner to become entitled to an EU Permit . Otherwise the alternative is to go for a Registered Partnership Visa which will be given on presentation of evidence that you have been together for 2 years.

    When will his BUNAC visa run out? Is it sometime next week whilst in France. I wouldn't advise you to go to the British Consulate in Paris without evidence that you have been in a relationship for 2 years. His Passport is likely to be stamped on application and then refused if you are unable to provide proof of the relationship.

    Thanks for the info. That's what I was fearing to be honest - it sounded too easy. His BUNAC visa runs out on the 6th June as well, and we don't have enough money for me to keep supporting him. I guess he'll have to go back to the US while we apply for a marriage visa.
