✎ EN Overstayed EEA state applying EEA FP

    Hi everyone!

    I'm non EEA national living here in Spain. Got a partner Spanish citizen here and we have been living together for more than two years. I entered Spain via Scchengen Visa route. And now it was already expired and I am overstayed now. We are planning to work and live in UK and get married there. Now my questions are:

    1. Can I apply here in UK embassy-Spain of an EEA FP unmarried partner even though I am overstayed here?

    2. Is it a grounds for me of being overstayed in Spain in applying EEA FP as an unmarried partner?

    We have a proof that we are in a durable relationship like residence certificate, joint acct both names, pictures, remittances both names, etc.

    I have read in UKBA site that in applying EEA FP you don't need to be lawfully resident in any country. Can someone clarify me about this please.
