EU married to non EU want become British

Postby polishgirl » Fri Jul 13, 2012 4:56 pm

I'm a new in here and I really need help !

I'm EU member ( Poland ) and married to non EU. I would like to apply fro British citizenship in this year but I'm no sure how this can change my husband

status to get Permanent Residency and following after British passport.

1 - I came to England 04 / 2006

2 - 10 / 2008 I married with non EU

3 - 02 / 2009 my husband received Resident Card

and

4 - I'm over 6 years in England and like to apply for British passport

but

if I become British and keep my Polish citizenship ( dual nationality )

5 - Did my husband ( in 10 / 2013 will be 5 years on lawful residency ) can still apply for Permanent Residency based on married EU member ?

6 - Or will be better if I will wait and apply for British passport after my husband will get Permanent Residency and ten he will be able to apply for British

passport no matter I will be still EU member or British citizenship ?

Thank you very m uch for your help

Be careful! The rules changed (yesterday) and dual nationals are no longer treated as EEA members. There is a blog about it here if it's okay to link to an outside source.

I would wait until your husband is entitled to permanent residency, and then apply. He can apply for citizenship one year after getting permanent residency too.

But if you are living in the UK permanently, have you thought about what happens in future if you or your husband want to bring elderly parents here? Under EEA rules that is a simple application but under UK laws it's now really, really difficult. If you naturalise then you are likely to be cutting off that option. So do think about it before you make the leap! Your family members have more rights while you are a Polish national.

Thank you for your response.

Yes , you are wright - I will waiting untill my husband gets permanent resisdency but personally I don't think that EEA rules will be stronger for long time, consider what is going with all economic and political shape of all EU.
For me is more wise to become a british citizen if I'm living here but I appreciate all advise you give me.
