Not sure what you could do.
You are dependant of the EU national.Your husband is non EU who would like to join you,who would be dependant of the dependant of the EU national.
I can only guess, and I wont do that.
Maybe chat with the immigration lawyer would be helpfull.
    Anyone else got better idea?!

I dont think you could apply under EU rules as you are already dependant of the EU national.
He could probably apply as spouse of the person on limited leave to remain, thats you.
This my best guess. But as I said I am not sure so you would be probably best advised to ask for second opinion.

i have same situation as yours
i meet one solicitor today he told me to apply Non-Settlement spouse visa, and he told me that my wife will get visa upto what i have got then after we both as well as my parents have to send passort to home office for FLR. i dont if it is possible in my case or not. it seems like he wanted me my wife to apply similar visa as the Dependent of HSMP applies.

it looks smilar advice as Triple H has give before on this comments
