    hello

am in the same predicament as you.am a nigerian married to a spaniard and am planning to move down to spain.anyway firstly, you need to get you marriage certificate legalized.do you live in London? if you do,go to www.conspalon.org.if not well you will need to go the spanish consulate in the country you reside and your spanish partner needs to have a recent birth certificate and her family's libro de familia and you go with all these to the consulate and register your marriage.this is the most important!

    Hi Patcha,

Please find below information regarding documents required from non-EU spouses of non-Spanish, but EU citizens. I think chicapantera thought you were married to a Spaniard, in which case what she wrote would be accurate.

    Good Luck!

CONDITIONS OF APPLICATION FOR DEPENDANTS OF OTHER EUROPEAN UNION NATIONALS:

    1. 4 visa application forms fully completed and signed by the applicant at the bottom of the page.
    2. 4 recent passport size photographs.
    3. Passport with a minimum validity of 120 days and photocopy of the whole passport, minus the blank pages.
    4. Passport of the European national moving or living in Spain and photocopy of the pages with the relevant information.
    5. Original Marriage Certificate, or Birth Certificate in the case of ascendants and descendants.
In cases where documents are not from the EU the Hague Convention Apostille will be required together with a translation of the documents, proving that the ascendant or descendant is a family dependant.
Photocopies will be required of all the documents.
    6. The EU national should have financially maintained the dependant relative for up to one year prior to the application.

Please note that a Police Certificate or “Certificado de penales”, stating that the applicant does not a have a criminal record might be exceptionally requested under certain circumstances either by the Consulate or the Spanish Police upon arrival in Spain.

NB: These requirements are for the Spanish Consulate in London; the requirements in terms of application forms and passport photos vary from country to country, but I think all other requirements are the same.
