    Hello Everyone,

    I am the mother of 2 EU nationals, and derive my residence rights from them. I have previously been granted a EEA family permit for the uk based on my son, and to the best of my understanding it should allow me to work and study in the uk.

    The problem is that i am a dentist, who is not registered yet. I want to apply for temporary registration with the GDC, but need to fulfill visa requirements, that allow me to work and study at the hospital.....I am assuming EEA family permit allows me to but don't know.

    what if i want to work for periods longer than 6 months, can i extend in the uk or do i have to leave to rome, where i currently live every 6 months for 2 weeks?

    If i wanted to apply for a residence card, as my children are young 3years and 15 months, does enrolling my youngest in a daycare , cover treaty rights.

    You should not have to worry about work conditions.
    Family members of nationals of the majority of EEA states are permitted to live and work in the UK without restriction, in the same way as the EEA national themselves (although there are restriction with family members of A8 nationals - the 8 countries that joined the EEA in 2004, and with A2 nationals - Bulgarians and Romanians).

    It is highly recommended to apply for a Residence Card (using Form EEA2) inside the UK (because without it, there might be difficulties to demonstrate to any potential employers that you have the right to work in the UK, as you are not EEA). But it might take a long time 6 months, sometime more. However it does not stop you from staying, studying or working in the UK in the meantime.

    I have a similar situation here but a bit different, for which I ask for support.
    My wife is a Dentist. She is a EEA national and decided to move to UK. Dentist is of course a Self-employment, she will start from scratch, meaning that when we enter in UK, she will not have a job, but will start looking for one.
    I am not a EEA national and work in a multinational company. After her decision (to move to UK), I started searching a position for me and found it. But I cannot be expatriated. I need to own a work permit in order for the company can hire me.
    By the rule I read, it is first necessary for me to apply for a residence card, wait 6 months and then move to UK. Of course no company will wait 6 months for his candidate to show up and start work. They also don't want to pay the transfer or sponsorship fee.
    In that case, can we (me and my wife) just move to UK and when entering get the license or permition that allows me (as non-EEA member) to work because I am accompanying my wife, that at thee moment she is entering in the UK will not have a job yet? I have a offer letter with me.

    Can anybody help me with this case?

    As I said above, family members of nationals of the majority of EEA states are permitted to live and work in the UK without restriction, in the same way as the EEA national themselves. So as a family member (husband) of a EEA national, you are entitled to work without restriction, providing the fact that your wife is exercising here treaty rights, either:

    - Employment;
    - The process of seeking employment;
    - Self-employment;
    - Self sufficiency;
    - Study.

    PS: I'm not a specialist and I strongly recommend you take confirmation/advice from officials (the consulate...etc).

    Thank you very much for your quick response. It helped a lot.

    Everything looks good, but there is one small piece of the condition that I am not fully convinced about.
    As far as I understood, in order to be considered as on "the process of seeking employment", she must satisfy the condition of being involuntary unemployed after having been employed in the UK, which is not totally the case, because she have never worked in UK.
    We are both curently working in and living in Brazil.

    Due to the fact that I own an offer letter from an international company, the only thing I need is that the government provides me with some license or authorization that allows me to work when entering in the UK, accompanied by my wife, who is a EEA citizen. My wife and I will move together, but from now, only I have the offer letter and I am only a family member of a EEA citizen.

    What do you think about it?

    In the document called EEA nationals: the 'right to reside' requirement for benefits: http://www.parliament.uk/briefing-papers/sn05972.pdf‎, from the Parliament it says:
    So she can register with the Jobcentre without claiming benefits in order to exercise here treaty righ and allow you to work.

    But as I found also on a website on work permits, there is also the possibility that with you working, she is self-sufficient and also exerces her treaty right as she does not claim benefits.

    Thank you. That makes much more sense now.
    So, she (and me with her) has the right to reside by exercising the Treaty Rights. In what timeframe this (right to reside) is given?
    Is it when we enter the country? Or should this be requested in advance via a form?
    Dos it take long to be given?

    There is no need for her to have any document.

    For you, as a non-EEA but being married to a EEA and coming with her, whilst it may be possible to gain entry to the UK without first applying for a visa, it is advisable first to apply for an EEA ‘Family Permit’. This is a type of visa issued for six months to family members of European nationals seeking entry to the UK. Applications for Family Permits should be made to the nearest British Diplomatic Post, and do not attract an application fee.
