✎ EN British Citizens non-eu citizens spouse right ?

    Hi there, i'm new on this website. I'm British Citizens married to Non-EU citizens Thai citizens. I want to go back to live in the UK and bring my thai wife to live with me in the UK but we applied for the settlement visa at the British High Commission in Nicosia and they refused my wife's settlement visa last month. They said to me i'm not an EEA national. I'm British Citizens who live in Cyprus and came to live in Cyprus for do business at there and I opened the business as CranioSacral Therapist at the Larnaca City in Cyprus and I have registration certificate "Yellow Slip" and my wife has the residence card "Yellow Slip" for resire to live in Cyprus. I searched the EU Laws website which many pages said the same about "I HAVE RIGHT TO BRING MY NON-EU CITIZENS TO LIVE WITH ME IN THE UK" BECAUSE AM EU CITIZENS. BUT THE FACT IS NOT HAPPEN LIKE THAT.

    I need to go back to live in the UK with my thai wife but we are waist time for applied the visa and the EU Law said my wife don't need the visa to get to the UK and have right to live with me in the UK too.

    What's going on with the British High Commission treat to many people like these?

    I need help and good advice from anybody who know about this information.

    Looking forward to get good answer from anybody on this Forum soon possible!

    If you are applying under EU law ( which you are entitled to apply once you have lived in an EU country - other than the UK - for at least six months ), you should have applied for EEA Family Permit not a settlement visa under the UK immigration laws.

    We know that now but the High Commission advised us to go for the Settlement Visa.

    You've recieved correct information from British high commission. If you're UK national willing to bring your wife to uk, you have to follow settlement visa procedure. Goodluck!

    The Settlement Visa requires an English Languge Test Certificate which is NOT AVAILABLE in the country we live in (Cyprus)!

    We've already lost Euros 960 in this futile escapade with no practical help form the High Commission except to repeat that we must have the test....yeah! Where?

    End of story.

    Who told you that IELTS is not available in Cyprus? Of course it is! Exams are run 2 to 4 times a month by the British Council in Nicosia from whom you can but study materials too.Not only that, if you sign up for an exam, you get access to 30 hours of online study material. Its a lot better than you get in most countries.

    Regarding UK admission for your wife, you could have found all the information that you need, explained in great detail, just by looking on the UK border agency website.

    You need to further study the EU legislation on freedom of movement. Except in limited cisrcumstances, the right of the Non EEA spouse to an EEA family permit only applies where the spouse is accomanying the EEA spouse to an EEA country OTHER THAN than the one which the spouse is a citizen of.

    If your wife is entitled to an EEA family permit, it is easy to get withing a few days, and in some countries may be issued on the spot. It is up to you to check entitlement. An easy way is to complete the application form and submit it with the relevant documents.Your costs would be negligible
    EEA family permits are free.Visas are not!

    A word of warning.Taking a spouse into the UK by the family permit route has disadvantages if she is wants to seek permanent residence in the UK later.First, she will need to get a residence card before her 6 months family permit runs out, and it might not be granted. More important is that once the EEA route has been chosen, you cannot switch back to the settlement route, meaning that permanent residence and citizenship will take a lot longer under present immigration 'rules', and whether they are ever granted, will be entirely at the discretion of the UK, not the EU.

    My wife and I visited The British Council, Nicosia twice in person. They assured us that they did NOT run the required language test (A1 level speaking and listening test). The only exams they run are for advanced level students pursuing University entrance and the like. We asked the High Commission where we could acquire the A1 test but they were unable, or unwilling, to provide any information!
